CIRCULAR
GUIDANCE DEFINING EXPENDITURE LEVEL FOR ELABORATION, APPRAISAL AND PUBLICATION OF SOCIO-ECONOMIC DEVELOPMENT OVERALL PLAN; SECTOR, FIELD AND KEY PRODUCT DEVELOPMENT PLAN
Pursuant to the Government’s Decree No. 116/2008/ND-CP , of November 14, 2008 stipulating functions, tasks, powers and apparatus organizational structure of the Ministry of Planning and Investment;
Pursuant to the Government’s Decree No. 92/2006/ND-CP, of September 07, 2006 on elaboration, approval and management of socio-economic development overall plan;
Pursuant to the Government’s Decree No. 04/2008/ND-CP, of January 11, 2008 on amending and supplementing a number of articles of the Government’s Decree No. 92/2006/ND-CP on elaboration, approval and management of socio-economic development overall plan;
Pursuant to the Directive No.2178/CT-TTg, of December 02, 2010 of the Prime Minister on strengthening the planning work;
The Ministry of Planning and Investment guides defining expenditure level for formulation, appraisal and publication of socio-economic development overall plan; sector, field and key product development plan as follows:
Chapter 1.
GENERAL PROVISIONS
Article 1. Scope of regulation
This Circular guides defining the expenditure level for elaboration (including elaboration of new ones and adjustment), appraisal and publication of the socio-economic development master plan; sector, field and key product development plan specified in the Government’s Decree No. 92/2006/ND-CP, of September 07, 2006 on elaboration, appraisal and publication of the socio-economic development master plan and the Government’s Decree No. 04/2008/ND-CP, of January 11, 2008 amending and supplementing a number of articles of the Government’s Decree No. 92/2006/ND-CP, of September 07, 2006 on elaboration, appraisal and publication of the socio-economic development master plan (hereinafter referred to as the planning project), including:
1. The socio-economic development master plans for socio-economic areas, key economic areas, economic corridors, and economic belts (hereinafter referred to as the regional zoning projects).
2. The socio-economic development master plans of central-affiliated cities and provinces (hereinafter referred to as provincial zoning projects).
3. The socio-economic development master plans of districts, townships, province-affiliated cities (hereinafter referred to as the district-level zoning projects).
4. The national sector, field and key product development plans.
5. The sector, field and key product development plans of central-affiliated cities and provinces.
Article 2. Subjects of application
1. This Circular applies to agencies, organizations, individuals related to elaboration, appraisal, management and publication of the zoning projects by the State budget’s capital source.
2. Organizations, individuals are encouraged to use capital sources not covered by the State budget for elaboration, appraisal, and publication of the zoning projects in according to provisions in this Circular.
Article 3. Principles to define expenditures
1. The expenditure norm specified in this Circular is the maximum necessary costs for implementation of entire content of elaboration, appraisal, approval and publication of the zoning projects.
2. The expenditure norm specified in this Circular is excluded added value tax; cost for organization to select contractors as prescribed; cost for exploration and surveying (or buying) map (topographic, geological, administrative maps and other map types) of zoning areas; cost for elaboration of the strategic environmental assessment report.
Based on the approved zoning requirements and tasks, in necessary case there must be above expenditures, the assigned units shall make estimation supplementing the detailed estimation in according to the zoning task on the basis of application of relevant expenditure norms promulgates by competent state agencies and submit to competent authorities for decision as guides in Annex X.
3. In case cost for hiring foreign consultants to elaborate the zoning projects by the State budget’s capital source exceeding the norms specified in this Circular, they must be agreed by authorities competent to decide under current regulations.
Article 4. Basis to define expenditure norms:
The expenditure norms specified in this Circular are elaborated on the basis of the minimum wages specified in the Government’s Decree No. 22/2011/ND-CP , of April 04, 2011 being 830,000 dong/month and the Consumer Price at time point of promulgation of this Circular. If the general minimum wage and Consumer Price are changed, estimation for the zoning project at a specific time point shall be adjusted by K
K is coefficient to adjust the minimum wage and Consumer Price defined according to guides in Annex XI of this Circular.
Chapter 2.
SPECIFIC PROVISIONS
Article 5. The expenditure norms for projects on provincial and regional-level socio-economic development master plan
1. The calculation formula: The expenditure norms for provincial and regional-level zoning projects are calculated by the following formula:
GQHVT = Gstandard x H1 x H2 x H3 x K
In which:
GQHVT means total expenditure level for the provincial and regional-level socio-economic development master plans (unit is million dong).
Gstandard = 850 (million dong), means expenditure level for the socio-economic development master plans of standard locality (being a presumed locality with scale of 1,000 km2, the population density of 50-100 persons/km2 and having optimal advantage conditions for planning elaboration).
H1 – the coefficient of level of zoning locality defined in the Annex I.
H2 – the coefficient of working conditions and level of socio-economic development of the zoning locality defined in the Annex II.
H3 – the coefficient of the natural area scale of zoning locality defined in the Annex III.
K- coefficient adjusting minimum wages and consumer price. At time point of promulgating this Circular K = 1, In case there are adjustment of minimum wages of State and consumer price announced by competent authorities; coefficient K shall be defined in Article 4 of this Circular.
2. Norms for expenditure items of the regional zoning project are specified in Annex IV.
3. Norms for expenditure items of the provincial zoning project are specified in Annex V.
Article 6. The expenditure norms for projects on district-level socio-economic development master plan
The expenditure level for a district-level zoning project is calculated by percentage (%) of the maximum expenditure level of the provincial zoning project where having that district, or township, or city.
1. The expenditure level for a district-level zoning project shall not exceed 40% of the maximum expenditure level of provincial zoning project of that district.
For island districts, the expenditure level for an island district-level zoning project shall not exceed 50% of the maximum expenditure level of provincial zoning project where having that island district.
2. The expenditure level for a district-level zoning project of township, or provincial-affiliated city shall not exceed 50% of the maximum expenditure level of provincial zoning project where having that township or provincial-affiliated city.
3. Norms for expenditure items of the district zoning project are specified in Annex VI.
Article 7. The expenditure norms for the development zoning projects of sectores, fields and key products
1. The calculation formula: The expenditure norms for the development zoning projects of sectores, fields and key products are calculated by the following formula:
GQHN = Gstandard x H1 x H2 x H3 x Qn x K
In which:
GQHN means total expenditures for the development zoning projects of sectores, fields and key products (unit is million dong)
Gstandard and coefficients H1, H2, H3 are defined as clause 1, Article 5 of this Circular.
Qn – means the coefficient of difference among the development zonings of sectores, fields and key products defined in Annex VII
K- coefficient adjusting minimum wages and consumer price. At time point of promulgating this Circular K = 1, In case there are adjustment of minimum wages of State and consumer price announced by competent authorities; coefficient K shall be defined in Article 4 of this Circular.
2. Norms for expenditures of the national development zoning projects of sectores, fields and key products specified in Annex VIII.
3. Norms for expenditures of the provincial development zoning projects of sectores, fields and key products specified in Annex IX.
4. Norms for expenditures of the development zoning projects of a sector, field being member of a sector, key field shall not exceed 50% of norm defined for that sector or key field.
Article 8. The expenditure norms for the zoning adjustment projects
The expenditure level for zoning adjustment projects is defined by estimation on the basis of content which needs be adjusted in the approved zoning.
1. For zonings have been performed for 5 years or more, the expenditure level shall not exceed 65% of total expenditure at the maximum level of the newly-elaborated project of that zoning at time point of estimation elaboration.
2. For zonings need be adjusted according to clause 2, Article 4, of the Government’s Decree No.92/2006/ND-CP, of September 07, 2009 on elaboration, approval and management of socio-economic development master plan, the expenditure level shall not exceed 10% of total expenditure at the maximum level of the newly-elaborated project of that zoning at time point of estimation elaboration.
3. The norms for expenditures of the zoning adjustement projects (calculated by percentage of total expenditure level) shall be applied for expenditures of the newly-elaborated projects of zoning.
Chapter 3.
ORGANIZING IMPLEMENATION
Article 9. Effect
This Circular takes effect on April 01, 2012 and replaces the Decision No. 281/2007/QD-BKH, of March 26, 2007 of the Minister of Planning and Investment on promulgation of expenditure norms for the zoning elaboration, appraisal and adjustment of the socio-economic development master plan, sector planning and key product planning; replaces section 3 of the Circular No. 03/2008/TT-BKH, of July 01, 2008 of the Ministry of Planning and Investment guiding implementation of a number of articles of the Government’s Decree No. 04/2008/ND-CP, of January 11, 2008 amending and supplementing a number of articles of the Government’s Decree No. 92/2006/ND-CP, of June 07, 2006 on elaboration, approval and management of the socio-economic development master plan.
Article 10. Transitional provisions
1. For the zoning projects of which outlines, tasks and estimations of zoning elaboration have been approved by competent authorities before the effective day of this Circular and have been signed contract to hire consultants shall comply with the approved Decision.
2. In case outlines, tasks and estimations of zoning elaboration have been approved by competent authorities before the effective day of this Circular but not yet signed contract to hire consultant for zoning elaboration, persons competent to approve estimation shall has right to adjust estimation as prescribed in this Circular.
3. Funding for implementation of zoning projects shall be allocated in the assigned estimation of Ministries, sectors and localities.
In the course of implementation, any arising problems should be reported to the Ministry of Planning and Investment for research and settlement.
