ON PROMULGATING, GUIDING USE AND MANAGEMENT OF TYPES OF FORMS INVOLVING MANAGEMENT OF ENTRY AND EXIT

Pursuant to the 2000 Ordinance on entry, exit and residence of foreigners in Vietnam;

Pursuant to the Government’s Decree No. 21/2001/ND-CP, of May 28, 2001 detailing the implementation of the 2000 Ordinance on entry, exit and residence of foreigners in Vietnam;

Pursuant to the Government’s Decree No. 136/2007/ND-CP, of August 17, 2007, on exit and entry of Vietnamese citizens;

Pursuant to the Government’s Decree No. 77/2009/ND-CP, of September 15, 2009 defining the functions, tasks, powers and organizational structure of the Ministry of Public Security;

Pursuant to the Decision No. 45/2006/QD-TTg, of February 28, 2006 of the Prime Minister promulgating Regulation on issuance and management of APEC business travel cards;

Pursuant to the Joint Circular No. 05/2009/TTLT-BCA-BNG, of May 12, 2009 of the Ministry of Public Security and  the Ministry of Foreign Affairs, guiding procedures for overseas Vietnamese to register permanent residence in Vietnam;

At the proposal of Director of Security General Department I,

The Minister of Public Security promulgates the Circular on promulgating, guiding use and management of types of forms involving management of entry and exit.

Article 1. Scope and Subjects of application

1. This Circular promulgates, guides use and management of types of forms involving management of entry and exit.

2. Subjects of application are Vietnamese and foreign agencies, responsibilities, enterprises; foreign individuals and Vietnamese citizens involving settlement of exit and entry.

Article 2. Forms of papers involving management of foreigners entry, exit and reside

1. Official Dispatch replying to the request for verification and approval on personnel problem for foreigners going entry (form N4A).

2. Official Dispatch replying to the request for inspection on personnel problem for foreigners going entry (form N4B).

3. Official Dispatch replying to the request for grant of visa at international border-gates (form N4C).

5. Telegraph request (form N4E).

6. Glued visa (form N6A).

7. Detached visa (form N6B).

8. Stamp to extend duration of temporary residence (form N6C).

9. Notification (on foreigners applying for permanent residence) (form N11A).

Article 3. Forms of papers involving management of overseas Vietnamese to register permanent residence in Vietnam

1. Written acceptance of registration for permanent residence at house under legal ownership of individuals (form TT02).

2. Official Dispatch sending to Public Security Departments of provinces and centrally-run cities in order to notify result of settlement for overseas Vietnamese to return Vietnam and register permanent residence (form TT04).

Article 4. Forms of papers involving verification and receipt of women, children subject to trafficking, now return Vietnam from overseas

1. Report used for women, children subject to trafficking, now return Vietnam from overseas (form TK-PNTE)

2. Record on delivery and receipt of women, children subject to trafficking, now return Vietnam from overseas (form BBGN-PNTE).

3. Certificate of returning for women, children subject to trafficking, now return Vietnam from overseas (form CN-PNTE (A) issued by Exit and Entry Management Department.

4. Certificate of returning for women, children subject to trafficking, now return Vietnam from overseas (form CN-PNTE (PA) issued by Divisions of Exit and Entry Management under Public Security Departments of central-affiliated cities and provinces.

1. Report on loss of ABTC in home country (form X06).

Article 6. Guiding use of types of forms

1. Agencies, organizations, enterprises and individuals, who have demand to be granted types of papers on exit and entry, shall be supplied types of papers on exit and entry by Exit and Entry Management Department or Exit and Entry Management Divisions, provincial Public Security Departments, overseas Vietnamese representative mission or they may access in website of Exit and Entry Management Department in order to print out and use. 

2. Types of forms of papers on exit and entry must be printed, copied and used in accordance with specification and content of each form specified in Articles 2, 3, 4 and 5 of this Circular.

Article 7. Printing and management of types of forms of papers

To assign Exit and Entry Management Department in taking responsibility for:

1. Printing types of forms of white publications (visa, temporary residence card, permanent residence card, AB stamp, etc) In order to settle demand on exit, entry, residence of foreigners and Vietnamese citizens at Exit and Entry Management Department and Exit and Entry Management Divisions under provincial Public Security Departments.

2. Printing and supplying types of white publications for the Ministry of Foreign Affairs (Consular Department and overseas Vietnamese representative mission) in order to settle demands on exit, entry, residence of foreigners and Vietnamese citizens at Consular Department and in other countries.

3. To supply types of form and guide the Exit and Entry Management Divisions under provincial Public Security Departments in printing and issuing for agencies, organizations, enterprises and foreigners, Vietnamese citizens who have demands on exit, entry, residence for doing procedures at the Exit and Entry Management Divisions.

5. To publish types of forms of papers on website of Exit and Entry Management Department for agencies, organizations, enterprises and foreigners and Vietnamese citizens in order to access and use.

Article 8. Effect

This Circular takes effect from March 20, 2013.

Article 9. Responsibility for implementation

1. Directors General, heads of Ministerial-affiliated units; Directors of Public Security Departments of provinces and centrally-run cities shall, in scope of their functions and tasks, implement this Circular. 

2. The Security General Department I shall organize implementation and guide, inspect implementation of this Circular.

In the course of implementation, any arising problems should be reported to the Ministry of Public Security (through the Security General Department I) for timely guidance.
