CIRCULAR
REGULATING TARIFF-RATE QUOTA AND PREFERENTIAL IMPORT TARIFF RATE IN 2015 FOR IMPORTS FROM THE LAO PEOPLE'S DEMOCRATIC REPUBLIC
Pursuant to the Government’s Decree No. 95/2012/NĐ-CP dated November 12, 2012 defining the functions, tasks, entitlements and organizational structure of The Ministry of Industry and Trade;
Executing the agreement signed December 01, 2011 between the Government of the Socialist Republic of Vietnam and the Government of the Lao People's Democratic Republic for certain goods enjoying preferential import tariff rate;
Executing the Deputy Prime Minister Nguyen Xuan Phuc’s directions at the Document No. 422/VPCP/QHQT of the Government Office dated January 20, 2015 on extension of the agreement for preferential import tariff rate between Vietnam and Laos in 2015;
At the request of General Director of Import – Export Department;
The Minister of Industry and Trade promulgates the Circular regulating tariff-rate quota and preferential import tariff rate in 2015 for imports from the Lao People's Democratic Republic

Article 2. Conditions for enjoying import tariff rate as 0% within tariff-rate quota
1. The imports must be enclosed with Certificates of Origin (C/O form S) issued by the competent agency of the Lao People's Democratic Republic and be granted customs clearance at checkpoints specified in the Appendix 02 enclosed herewith. Procedures for imports are settled at the customs checkpoint where import procedures are carried out according to automatic differential principle (total quantity of imported goods that enjoy duty free tariff preference minus imported quantity of each goods item).
2. Vietnamese entrepreneurs shall be permitted to import paddy and rice of all kinds by tariff-rate quota.
For tobacco leaves and stems, only Vietnamese entrepreneurs who are granted permit for importing raw tobacco material according to tariff-rate quota issued by the Ministry of Industry and Trade according to the Circular No. 04/2014/TT-BCT dated January 27, 2014 detailing the implementation of a number of articles of the Government’s Decree No. 187/2013/NĐ-CP dated November 20, 2013 detailing the implementation of the law on international goods sale and purchase and goods sale, purchase, processing and transit agency activities with foreign countries are allowed to import (direct importing or import entrustment) Quantity of imports shall be subtracted from import tariff rate quota under the permit issued by the Ministry of Industry and Trade.
Article 3. Effect
This Circular takes effect since February 12, 2015 to the end of December 31, 2015./.
