CIRCULAR

MENDING AND SUPPLEMENTING ARTICLE 1 OF THE MINISTER OF SCIENCE AND TECHNOLOGY’S DECISION NO. 05/2005/QD- BKHCN OF MAY 11, 2005, AMENDING AND SUPPLEMENTING DECISION NO. 28/2004/QD-BKHCN OF OCTOBER 1, 2004, ON METHODS OF DETERMINING LOCALIZATION RATES OF AUTOMOBILES

Pursuant to the Government’s Decree No. 28/2008/ND-CP of March 14, 2008, defining the functions, tasks, powers and organizational structure of the Ministry of Science and Technology;

Pursuant to the Prime Minister’s Decision No. 175/2002/QD-TTg of December 3, 2002, approving the strategy on development of Vietnam’s automobile industry through 2010, with a vision towards 2020;

Pursuant to the Prime Minister’s Decision No. 177/2004/QD-TTg of October 5, 2004, approving the master plan on development of Vietnam’s automobile industry through 2010, with a vision towards 2020;

At the proposal of the general director of the Directorate for Standards, Metrology and Quality,

The Minister of Science and Technology issues this Circular to amend and supplement Article 1 of the Minister of Science and Technology’s Decision No. 05/2005/QD-BKHCN of May 11, 2005, amending and supplementing Decision No. 28/2004/QD-BKHCN of October 1, 2004, on methods of determining localization rates of automobiles.

“Article 1. To amend and supplement Clause 4, Article 5 of the Minister of Science and Technology’s Decision No. 28/2004/QD-BKHCN of October 1, 2004, on methods of determining localization rates of automobiles, as follows:

4. Automobile parts directly imported or purchased from commercial importers by enterprises shall not be regarded as localized ones.

a/ The knock-down levels of imported automobile parts are provided as follows:

- Automobile cover and body (for tourist car, minibus and bus) and cabin (for truck): Knocked down into at least 6 main parts, not yet electro- statically painted, including dome, floor, left side, right side, front, behind and associated part (if any).

- Automobile chassis: Already assembled together, not yet electro-statically painted. Automobile chasses of 3.7 m long or longer may be electro-statically painted before being imported.

- Engine: Completed and may be fit with clutch and gearbox.

- Transmission system: Fit or not yet fit with brake system.

- Electric, lamp and furniture system: Electric wires, switchboards, lamps and furniture in automobiles left unassembled from automobile cover and body or cabin.

- Truck tub: Floor, right side, left side, front and back of truck tub left unassembled and not yet painted and truck tub floor not yet assembled to auxiliary bodywork when being imported.

c/ Appendices 5 thru 8 to this Decision (not printed herein) only serve as illustration, and may not be used as a basis to determine the knock-down levels of parts of assorted automobiles.”

Article 2. Responsibility for organization of implementation

The Directorate for Standards, Metrology and Quality shall guide and organize the implementation of this Circular.

Article 3. Implementation provisions

1. This Circular takes effect on April 30, 2012.

2. The general director of the Directorate for Standards, Metrology and Quality, the director of the Department of Technology Appraisal, Examination and Assessment, the director of the Department of

Legislation, the director of the State Agency for Technology Innovation, the chief of the Office, and related organizations and persons shall implement this Circular.-
