CIRCULAR

PROMULGATING NATIONAL TECHNICAL REGULATION ON AQUACULTURE FEED

Pursuant to the Law on Promulgation of Legislative Documents dated June 22, 2015;

Pursuant to the Law on Standards and Technical Regulations dated June 29, 2006;

Pursuant to the Law on Fisheries dated November 21, 2017;

Pursuant to the Government’s Decree No. 15/2017/ND-CP dated February 17, 2017 defining the functions, tasks, powers and organizational structure of the Ministry of Agriculture and Rural Development;

Pursuant to the Government’s Decree No. 26/2019/ND-CP dated March 08, 2019 on guidelines for implementation of the Law on Fisheries;

At the request of the Director of the Department of Science, Technology and Environment and the Director General of the Directorate of Fisheries;

The Minister of Agriculture and Rural Development hereby promulgates National technical regulation on aquaculture feed.

Article 1. The National technical regulation on aquaculture feed is promulgated together with this Circular.

1. Aquaculture feed. Part 1: Compound feeds

Code: QCVN 02-31-1 : 2019/BNNPTNT.

2. Aquaculture feed. Part 2: Feed supplements

Code: QCVN 02-31-2 : 2019/BNNPTNT.

3. Aquaculture feed. Part 2: Fresh and live feeds

Code: QCVN 02-31-3 : 2019/BNNPTNT.

Article 2. This Circular comes into force from January 01, 2020.

Article 3. Chief of the Office of the Ministry of Agriculture and Rural Development; Director of Department of Science, Technology and Environment; Director General of Directorate of Fisheries; heads of affiliates of the Ministry of Agriculture and Rural Development; Directors of Departments of Agriculture and Rural Development of provinces and central-affiliated cities and relevant organizations and individuals are responsible for the implementation of this Circular.

Difficulties that arise during the implementation of this Circular should be promptly reported to the Ministry of Agriculture and Rural Development for its possible review or revision./.

PART 1: COMPOUND FEEDS

1. GENERAL

1.1. Scope

This document provides for safety criteria and maximum levels in compound feeds (HS code 2309.90.13; 2309.90.19) intended for use in aquaculture.

1.2. Regulated entities

This document applies to organizations and individuals involved in manufacturing and import of compound feeds intended for use in aquaculture in Vietnam.

1.3. Normative references

AOAC 986.15, Arsenic, cadmium, lead, selenium and zinc in human and pet foods by atomic absorption spectrometry (AAS) and anodic stripping voltammetry (ASV).

EN 16277:2012, Animal feeding stuffs - Determination of mercury by cold- vapour atomic absorption spectrometry (CVAAS) after microwave pressure digestion (extraction with 65 % nitric acid and 30 % hydrogen peroxide).

EN 16278:2012, Animal feeding stuffs - Determination of inorganic arsenic by hydride generation atomic absorption spectrometry (HG-AAS) after microwave extraction and separation by solid phase extraction (SPE).

4. MANAGEMENT REGULATION

4.1. Declaration of conformity

Organizations and individuals shall submit declarations of conformity of compound feeds as follows:

4.1.1. Regarding domestically manufactured products, the certification result given by the certification body registered or accredited as prescribed by law shall be sent.

4.1.2. Regarding imported products, the certification or assessment result given by the certification body or the conformity assessment body registered or accredited as prescribed by law shall be sent.

4.2. Conformity assessment

Organizations and individuals shall assess conformity of compound feeds as follows:

4.2.1. Regarding domestically manufactured products, Method 1 (Representative form testing) shall be adopted.

4.2.2. Regarding imported products, Method 7 (Testing and evaluation of batches of goods) shall be adopted.

4.3. Procedures and documentation requirements for declaration of conformity are specified in Clauses 3 and 4 Article 1 of the Circular No. 02/2017/TT-BKHCN dated March 31, 2017 of the Ministry of Science and Technology on amendments to the Circular No. 28/2012/TT-BKHCN dated December 12, 2012.

Departments of Agriculture and Rural Development of provinces and central-affiliated cities shall receive documents submitted for declaration of conformity by organizations and individuals registering their manufacturing and trading within provinces and cities.

4.4. Contents, sequence and principles of using conformity assessment methods are specified in the Appendix II of the Circular No. 28/2012/TT-BKHCN dated December 12, 2012 of the Ministry of Science and Technology.

5. RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS

Organizations and individuals mentioned in Section 1.2 shall comply with regulations of this document.

6. IMPLEMENTATION

6.1. The Directorate of Fisheries and Departments of Agriculture and Rural Development of provinces and cities shall inspect the implementation of this document as assigned by the Ministry of Agriculture and Rural Development.

6.2. The Directorate of Fisheries shall disseminate, provide guidance and cooperate with relevant authorities in organizing the implementation of this document.

6.3. In the cases where any of the regulations specified in this document is amended or replaced, the newest one shall apply.

1.2. Regulated entities

1.4. Interpretation of terms

For the purposes of this document, the terms below shall be construed as follows:

1.4.1. “feed supplement” means an ingredient or combination of ingredients added to a feed or diet to improve the nutritive balance or serve a specific purpose in aquaculture feeds.

1.4.2. “enzyme preparation” means a biological product containing one or more enzymes with or without a carrier.

1.4.3. “probiotic” means a biological product containing one or more strains of inactivated beneficial and live microorganisms with or without a carrier.

1.4.4. “prebiotic” means a biological product that includes nondigestible fibers (with or without a carrier) that stimulate the growth or activity of beneficial microorganisms in the tract.

1.4.5 “organic acid” means a feed containing one or more organic acids that play a beneficial role in improving digestion and/or promoting the health of animals or serving the purpose of feed preservation.
