CIRCULAR
GUIDING THE GRANTING OF PERMITS FOR IMPORT OF RAW MATERIAL TIMBER OF CAMBODIAN ORIGIN
Pursuant to the Government’s Decree No.57/1998/ND-CP of July 31, 1998 detailing the implementation of the Commercial Law’s provisions on goods export, import, processing and purchase and sale agency with foreign countries;
Pursuant to the Prime Minister’s Decision No.65/1998/QD-TTg of March 24, 1998 on the export of wood products and forest products, and the import of raw material timber and forest products;
Pursuant to the Government’s Document No.281/CP-KTTH of March 23, 2000 on the import of timber from Cambodia;
The Ministry of Trade hereby guides the procedures for granting of permits for the quotaed import of raw material timber of Cambodian origin, as follows:
I. GENERAL PROVISIONS
1. This Circular regulates the quotaed import of raw material timber of Cambodian origin, across land border.
2. Raw material timber specified in this Circular includes assorted log timber (whether peeled or not), sawn timber and planks of all categories.
Artificial boards, wood reclaimed from import containers and all other wood products, which are imported according to Clause 8, Article 1 of the Prime Minister’s Decision No.65/1998/QD-TTg of March 24, 1998 shall not subject to this Circular.
3. The transportation, delivery and reception of imported timber shall be effected through the following international border-gates and national border-gates:

2. Bu Prang (Road No.14).
3. Bo Nue (Road No.13).
4. Xa Mat (Road No.22B).
5. Moc Bai (Road No.22A).
6. Tinh Bien (Road No.2).
7. Xa Xia (Road No.17).
8. Vinh Xuong - Thuong Phuoc (Tien River).
4. Enterprises that have business registration certificates with appropriate goods lines, have already registered their own code numbers of export and import enterprises, and come up with complete and valid dossiers, shall be entitled to file applications for import of raw material timber of Cambodian origin.
II. DOSSIERS OF APPLICATION FOR IMPORT PERMITS

1. A written request of the applying enterprise, clearly stating the name(s) of timber-selling enterprise(s); timber categories, specifications (log timber, sawn timber or planks), sale volume and the border-gate of import.
2. Copies of business registration certificate and registration of code number of export and import business enterprise;
3. The original of the principled contract signed by the Vietnamese enterprise directly with the Cambodian enterprise(s);
4. A copy of the Cambodian Trade Minister’s written export permission, which clearly states the names of the Cambodian enterprise(s) permitted to export and of the Vietnamese enterprise permitted to import; timber categories, specifications and quality.
The Vietnamese Trade Ministry shall handle dossiers of enterprises upon receiving written export permission sent from the Cambodian Trade Ministry via the formal channels (Vietnam�s embassy or commerce chamber in Cambodia or Cambodia’s embassy or commerce chamber in Vietnam). In case of a written export permission sent by the Cambodian Royal Premier to the Vietnamese Prime Minister, the Trade Minister shall handle the enterprises� dossiers upon obtaining the Vietnamese Prime Minister’s instructions.
III. IMPLEMENTATION PROVISIONS
1. Those permits for import of raw material timber of Cambodian origin which were granted by the Trade Ministry before the issuance date of this Circular shall still be effective.
2. The procedures for paying for imported goods and the customs procedures for imports shall comply with the current regulations.
3. This Circular takes effect 15 days after its signing and replaces the Trade Ministry’s Circulars No.03/1998/TT-BTM of February 24, 1998 and No.27/1999/TT-BTM of August 30, 1999.
