CIRCULAR

PROMULGATING NATIONAL TECHNICAL REGULATION ON PRODUCTS AND GOODS OF BUILDING MATERIALS

Pursuant to the Law on Technical Regulations and Standards dated June 29, 2006;

Pursuant to the Government's Decree No. 81/2017/ND-CP dated July 17, 2017 on functions, tasks, powers and organizational structure of the Ministry of Construction;

At the request of the Director General of the Department of Science, Technology and Environment;

The Minister of Construction shall promulgate a Circular promulgating National technical regulations on products and goods of building materials.

Article 1. Promulgated together with this Circular is the National technical regulation on products and goods of building materials, code: QCVN 16:2019/BXD.

Article 2. This Circular comes into force from July 01, 2020 and supersedes the Circular No. 10/2017/TT-BXD dated September 29, 2017 of the Minister of Construction promulgating the National technical regulation on products and goods of building materials, code: QCVN 16:2019/BXD and guidelines for certification of conformity and declaration of conformity.

1. If a manufacturer/importer of goods of building materials has been issued with the certificate of conformity in accordance with QCVN 16:2014/BXD and QCVN 16:2017/BXD and such certificate remains effective, such manufacturer/importer is entitled to keeping using the certificate of conformity and respective conformity mark until the expiry of the certificate.

2. If the certificate of conformity issued to products or goods of building materials expires during the period between the promulgation date and the effective date of this Regulation and such products or goods of building materials are not on the list specified in QCVN 16:2019/BXD, the manufacturer/importer of such products or goods of building materials are not required to certify or declare their conformity.

3. If goods are imported into Vietnam during the period between the promulgation date and the effective date of this Regulation: if the certificate of conformity is issued before the effective date of this Regulation, assess conformity and issue the certificate of conformity under QCVN 16:2017/BXD; if the certificate of conformity is issued after the effective date of this Regulation, assess conformity and issue the certificate of conformity under QCVN 16:2019/BXD.

4. A body designated to certify conformity or conduct testing of products or goods of building materials under QCVN 16:2017/BXD is entitled to keep certifying conformity and conducting testing of such products or goods of building materials within the effective period of the decision on designation.

If the decision on designation expires during the period between the promulgation date and the effective date of this Regulation, an extension may be granted until the effective date of this Regulation.

If the decision on designation expires after the effective date of this Circular and the products or goods of building materials are no longer on the list specified in QCVN 16:2019/BXD, the list of such products and goods eligible for that decision automatically expires.

5. A body that certifies conformity or conducts testing of products or goods of building materials in accordance with QCVN 16:2017/BXD shall determine its needs and competence according to QCVN 16:2019/BXD and submit an application to the Ministry of Construction for consideration and designation.

Article 4. Implementation

1. The Director General of the Department of Science, Technology and Environment shall organize and provide guidance on implementation of this Circular.

3. Difficulties that arise during the implementation of this Circular should be promptly reported in writing to the Ministry of Construction for consideration for consideration and instructions./.
