PROMULGATING AND IMPLEMENTING “NATIONAL TECHNICAL REGULATION ON GASOLINES, DIESEL FUEL OILS AND BIOFUELS”

Pursuant to the Law on Technical Regulations and Standards dated June 29, 2006 and Government’s Decree No. 127/2007/ND-CP dated August 01, 2007 elaborating a number of articles of the Law on Technical Regulations and Standards,

Pursuant to the Government's Decree No. 20/2013/ND-CP dated February 26, 2013 defining functions, tasks, entitlements and organizational structure of the Ministry of Science and Technology;

At the request of Director of Department of Science and Technology and Director of Department of Legal Affairs,

The Minister of Science and Technology hereby promulgates a Circular on promulgation and implementation of the “National technical regulation on gasolines, diesel fuel oils and biofuels”.

Article 1. The “National technical regulation on gasolines, diesel fuel oils and biofuels” (QCVN 1:2015/BKHCN) is promulgated together with this Circular.

Article 2. This Circular comes into force from January 01, 2016.

Article 5. The Director of Directorate for Standards, Metrology and Quality and heads of relevant organizations and individuals are responsible for implementation of this Circular.

QCVN 1:2015/BKHCN replaces QCVN 1: 2009/BKHCN.

QCVN 1:2015/BKHCN is drafted by Drafting Committee for national technical regulation on gasolines, diesel fuel oils and biofuels, submitted by the Directorate for Standards, Metrology and Quality and promulgated together with the Circular No. 22/2015/TT-BKHCN dated November, 2011 of the Minister of Science and Technology.

1. GENERAL PROVISIONS

1.1. Scope

1.1.2. This document does not apply to fuels used for aviation and defense purposes.

1.2. Regulated entities

This document applies to organizations and individuals related to import, production, preparing, distribution and retail of gasolines, diesel fuel oils and biofuels in Vietnam.

1.3. Definitions

For the purposes of this document, the terms below shall be construed as follows:

1.3.1. “unleaded gasoline” means a volatile mixture of petroleum-based liquid hydrocarbons  having boiling points in the range of from about 30°C to about 215°C, containing small amounts of appropriate but unleaded additives, and used as a fuel in an internal combustion engine.

1.3.3. “E10 gasoline” means a mixture of unleaded gasolines and fuel ethanol with an ethanol content of from 9% to 10% by volume, designated E10.

1.3.4. “diesel oil” means a volatile mixture of petroleum-based liquid hydrocarbons having boiling points in the range suitable for use as internal combustion engine fuel.

1.5.5. “B5 diesel fuel oil” means a mixture of diesel oils and biodiesel fuel blend stock with a methyl ester fatty acid (FAME) content of from 4% to 5% by volume, designated B5.

1.3.6. Biofuels

1.3.6.1. “fuel ethanol” includes undenatured fuel ethanol and denatured fuel ethanol.

1.3.6.1.1. “undenatured fuel ethanol” means the ethanol with impurities common to its production (including water).

1.3.6.1.2. “denatured fuel ethanol” means the ethanol denatured with gasolines or naphtha with the volume ranging from 1.96 % to 5.0 %.

1.3.6.2. “biodiesel fuel blend stock” means a fuel comprised of methyl esters of long chain fatty acids derived from vegetable oils or animal fats, not blended with other fuels, uses as diesel engine fuel and designated B100.

Fuel samples used to determine the specifications provided in this document shall be taken using TCVN 6777:2007 (ASTM D 4057-06) Petroleum and petroleum products - Method for manual sampling or TCVN 6022:2008 (ISO 3171:1988) Petroleum liquids - Automatic pipeline sampling and Petroleum product sampling methods issued by the Directorate for Standards, Metrology and Quality.

3.3. Utilization of test data

Test data on gasolines, diesel fuel oils and biofuels to determine conformance shall be utilized according to TCVN 6702:2013 (ASTM D 3244-07a) Standard Practice for Utilization of Test Data to Determine Conformance with Specifications.

4. MANAGEMENT REQUIREMENTS

4.1. Imported or domestically produced and prepared unleaded gasolines, E5 gasolines, E10 gasolines, diesel fuel oils and B5 diesel fuel oils shall have their conformance with specifications specified in Section 2 of this document assessed and certified, and comply with procedures according to applicable management requirements before they are sold on the market.

4.2. Assessment and certification of conformance of unleaded gasolines, E5 gasolines, E10 gasolines, diesel fuel oils and B5 diesel fuel oils with specifications specified in Section 2 of this document shall be carried out by the certifying organization designated or recognized by the Directorate for Standards, Metrology and Quality.

a) Conformance of domestically produced and prepared unleaded gasolines, E5 gasolines, E10 gasolines, diesel fuel oils and B5 diesel fuel oils with this document shall be assessed and certified using Method 5 "Test representative sample and assess the manufacturing process; carry out supervision by testing the sample collected from the manufacturing location or on the market in association with assessment of the manufacturing process " or Method 7 “Test and assess conformance of batches and lots”;

b) Conformance of imported unleaded gasolines, E5 gasolines, E10 gasolines, diesel fuel oils and B5 diesel fuel oils with this document shall be assessed and certified using  Method 7 “Test and assess conformance of batches and lots”;

4.4. Declarations of conformity of domestically produced and prepared unleaded gasolines, E5 gasolines, E10 gasolines, diesel fuel oils and B5 diesel fuel oils must be submitted as prescribed in the Circular No. 28/2012/TT-BKHCN dated December 12, 2012 of the Minister of Science and Technology.

Applications for inspection of quality of imported unleaded gasolines, E5 gasolines, E10 gasolines, diesel fuel oils and B5 diesel fuel oils must be submitted to the inspecting authority as prescribed in the Circular No. 27/2012/TT-BKHCN dated December 12, 2012 of the Minister of Science and Technology.

4.5. Quality of unleaded gasolines, E5 gasolines, E10 gasolines, diesel fuel oils and B5 diesel fuel oils that are imported, or domestically produced and prepared and sold on the market shall be conformable to this document, and such products shall undergo quality inspection as prescribed by law.

5. RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS

5.1. Organizations and individuals that produce, prepare and import unleaded gasolines, E5 gasolines, E10 gasolines, diesel fuel oils, B5 diesel fuel oils, fuel ethanol and biodiesel fuel blend stock shall declare applied standards in accordance with this document and ensure the quality of their product in conformity with regulations specified in this document and applied standards.

5.2. Organizations and individuals that produce and prepare unleaded gasolines, E5 gasolines, E10 gasolines, diesel fuel oils and B5 diesel fuel oils shall submit applications for issuance of the certificate of conformity and declarations of conformity as prescribed in this document.

Importers of unleaded gasolines, E5 gasolines, E10 gasolines, diesel fuel oils and B5 diesel fuel oils shall submit applications for issuance of the certificate of conformity and for quality inspection as prescribed in this document.

5.4. Fuel trading stations or other distributors and retailers shall provide information about type of gasolines and/or diesel fuel oils. To be specific:

- Regarding unleaded gasolines: octane number and emission standards

For example: RON90-II; RON92-II; RON95-II; RON92-III; RON95-III; RON98-III; RON92-IV; RON95-IV; RON98-IV

- Regarding biogasolines: research octane number, blending ratio of fuel ethanol, and emission standards

For example: E5 RON92-II; E5 RON95-II; E5 RON92-III; E5 RON95-III; E5 RON98-III; E10 RON92-IV; E10 RON95-IV; E10 RON98-IV

- Regarding diesel fuel oils: symbol of diesel fuel oils and sulfur content

For example: DO 0.05S; DO 0.035S; DO 0.005S

- Regarding B5 diesel fuel oils: symbol of diesel fuel oils, symbol B5 and sulfur content

For example: DO B5 0.05S; DO B5 0.035S; DO B5 0.005S.

6.1. The Directorate for Standards, Metrology and Quality shall provide instruct, inspect and cooperate with relevant authorities in organizing the implementation of this document.

According to management requirements, the Directorate for Standards, Metrology and Quality shall request the Ministry of Science and Technology to make amendments to this document.

6.2. In the cases where any of the legislative documents referred to or guidelines specified in this document is amended or replaced, the newest one shall apply./.
