CIRCULAR

FEES FOR MINING AND USE OF ENVIRONMENTAL DATA AND COLLECTION, TRANSFER, MANAGEMENT AND USE THEREOF

Pursuant to the Law on Fees and Charges dated November 25, 2015;

Pursuant to the Law on Hydrometeorology dated November 23, 2015;

Pursuant to the Government’s Decree No. 120/2016/ND-CP dated August 23, 2016 on elaboration of some Articles of the Law on Fees and Charges;

Pursuant to the Government’s Decree No. 38/2016/ND-CP dated May 15, 2016 on elaboration of some Articles of the Hydrometeorology;

Pursuant to the Government’s Decree No. 73/2017/ND-CP dated June 14, 2017 on collection, management and use of data on natural resources and environment;

Pursuant to the Government’s Decree No. 87/2017/ND-CP dated July 26, 2017 defining the functions, tasks, powers and organizational structure of the Ministry of Finance;

At the request of the Director of the Department of Tax Policy;

The Minister of Finance hereby promulgates a Circular on fees for mining and use of environmental data and collection, transfer, management and use thereof.

Article 1. Scope

1. This Circular provides for fees for mining and use of environmental data and collection, transfer, management and use thereof.

2. This Circular does not govern the mining and use of environmental data by regulatory authorities for the purposes specified in Clause 5 Article 32 of the Law on Hydrometeorology and Article 23 of the Government’s Decree No. 38/2016/ND-CP dated May 15, 2016.

Article 2. Regulated entities

1. Fee payers;

2. Fee collectors;

3. Other organizations and individuals related to mining and use of environmental data and fee collection and transfer.

Article 3. Fee collectors and fee payers

1. Fee collectors include:

a) Center for Environmental Information and Data affiliated to the Vietnam Environment Administration  (Ministry of Natural Resources and Environment);

b) Agencies assigned by Ministries and ministerial agencies to provide environmental information and data;

c) Departments of Natural Resources and Environment of provinces and central-affiliated cities.

2. Upon submitting applications for provision of environmental information and data to the agencies and units mentioned in Clause 1 of this Article, organizations and individuals are required to pay fees for mining and use of environmental data.

Article 4. Fees

1. Fees for mining and use of environmental data are provided in the Schedule of fees promulgated together with this Circular.

2. Fees for mining and use of environmental data that are effective from May 26, 2020 to December 21, 2020 inclusive are 70% of those specified in the Schedule of fees promulgated together with this Circular.

Article 5. Declaration and transfer of fees

1. Every fee payer shall transfer fees directly to the fee collector or to the fee collector’s designated state budget account which is opened at the State Treasury. If the fee collector collects fees using non-cash payment method, fees shall be transferred as notified by the fee collector.

2. By the 05th of every month, the fee collector shall transfer the collected in the previous month to the designated state budget account which is opened at the State Treasury.

3. Every collector shall declare and transfer collected fees on a monthly basis, and make statement of fees on an annual basis in accordance with regulations laid down in Clause 3 Article 19 and Clause 2 Article 26 of the Circular No. 156/2013/TT-BTC dated November 06, 2013 of Minister of Finance.

Article 6. Management and use of fees

1. The fee collector that is a public service provider may retain 70% of the total amount of collected fees in order to cover its costs in accordance with regulations in Article 5 of the Government’s Decree No. 120/2016/ND-CP dated August 23, 2016. The remaining amount (30%) must be transferred to the state budget as prescribed.

2. The fee collector that is a regulatory agency shall transfer 100% of the collected fees to the state budget. Budget for data provision and fee collection shall be included in the fee collector's estimate according to the policies and limits on State budget expenditures.

Article 7. Implementation and implementation clause

1. This Circular comes into force from May 26, 2020.

2. Other contents related to the collection, transfer, management and use of fees, receipts and announcement of regulations on the fee collection, which are not provided for in this Circular, shall comply with the Law on Fees and Charges, the Government's Decree No. 120/2016/ND-CP dated August 23, 2016, the Circular No. 156/2013/TT-BTC dated November 06, 2013 and Circular No. 303/2016/TT-BTC dated November 15, 2016 of the Minister of Finance.

3. In the cases where any of the legislative documents referred to in this Circular is amended or replaced, the newest one shall apply.

4. Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Finance for consideration./.
