PROMULGATING THE NOMENCLATURE OF EXPORTS AND IMPORTS WITHIN THE CULTURAL MANAGEMENT OF THE MINISTRY OF CULTURE, SPORTS AND TOURISM WITH CODES DETERMINED UNDER VIETNAM’S NOMENCLATURE OF EXPORTS AND IMPORTS

Pursuant to the Government’s Decree No. 113/2013/ND-CP dated October 2, 2013 on art activities;

Pursuant to the Government’s Decree No. 72/2016/ND-CP dated July 1, 2016 on photographic activities;

Pursuant to the Government’s Decree No. 03/2017/ND-CP dated January 16, 2017 on casino business;

Pursuant to the Government’s Decree No. 69/2018/ND-CP dated May 15, 2018 elaborating the Law on Foreign Trade Management;

Pursuant to the Government’s Decree No. 79/2017/ND-CP dated July 17, 2017 defining the functions, tasks, entitlements and organizational structure of the Ministry of Culture, Sports and Tourism;

At the request of Director of Department of Finance and Planning;

The Minister of Culture, Sports and Tourism promulgates a Circular promulgating the nomenclature of exports and imports within the cultural management of the Ministry of Culture, Sports and Tourism with codes determined under Vietnam’s Nomenclature of Exports and Imports.

4. Appendix 04: Nomenclature of imports under given conditions within the cultural management of the Ministry of Culture, Sports and Tourism determined under HS codes;

5. Appendix 05: Nomenclature of goods banned from export within the cultural management of the Ministry of Culture, Sports and Tourism determined under HS codes;

6. Appendix 06: Nomenclature of goods banned from import within the cultural management of the Ministry of Culture, Sports and Tourism determined under HS codes.

Article 2. Rules for using the Nomenclature

1. Rules for application:

a) In case of listing only 4-digit HS codes, all 8-digit HS codes of this 4-digit HS codes are applied.

b) In case of listing only 6-digit HS codes, all 8-digit HS codes of this 6-digit HS codes are applied.

c) In case of detailed listing to the 8-digit HS codes, only those 8-digit HS codes shall be applied.

3. In case such goods are not identified in any HS code on the Nomenclature of exports and imports (or such goods do not have HS codes), in carrying out export and import procedures, samples of such goods must be taken for assessment by competent agencies to serve the classification of HS codes.

Article 3. Entry in force and implementation

1. This Circular comes into force as of October 9, 2018.

2. Appendix 1 of Nomenclature of exports and import classified by HS codes within the cultural management of the Ministry of Culture, Sports and Tourism issued together with Circular No. 28/2014/TT-BVHTTDL dated December 31, 2014 of the Minister of Culture, Sports and Tourism on management of international sale of goods within cultural management of the Ministry of Culture, Sports and Tourism ceases to be effective from the effective date of this Circular.

3. Department of Finance and Planning affiliated to the Ministry of Culture, Sports and Tourism is an advisory agency which assists the Minister of Culture, Sports and Tourism to initiate and provide guidelines for this Circular.

Difficulties that arise during the implementation of this Circular should be reported to Department of Finance and Planning affiliated to the Ministry of Culture, Sports and Tourism for consideration./.
