NATIONAL TECHNICAL REGULATION FOR POWDER MILK PRODUCTS
MINISTER OF HEALTH
Pursuant to the Law on technical standards and regulations dated June 29, 2006 and the Government's Decree No. 127/2007/ND-CP dated August 01, 2007 detailing the implementation of a number of articles of the Law on Technical regulations and standards;
Pursuant to the Ordinance on food hygiene and safety dated August 07, 2003 and the Government's Decree No. 163/2004/ND-CP dated September 07, 2004 detailing the implementation of a number of articles of the Ordinance on food hygiene and safety;
Pursuant to the Government's Decree No. 188/2007/ND-CP dated December 27, 2007 defining the functions, tasks, powers and organizational structure of Ministry of Health;
At the request of Directors of Vietnam Food Administration, the Science and Education Department, and the Legal Department;
STIPULATES:
Article 1. QCVN 5-2:2010/BYT National technical regulation for powder milk products is enclosed herewith.
Article 2. This Circular takes effect as from January 01, 2011.
Article 3. Director of Vietnam Food Administration, heads of Ministry of Health’s departments and affiliates, directors of departments of health of provinces or central-affiliated cities, and relevant organizations and individuals shall implement this Circular./. /.

NATIONAL TECHNICAL REGULATION FOR POWDER MILK PRODUCTS
Foreword
QCVN 5-2:2010/BYT is compiled by the Committee for drafting of the National technical regulations on food safety and hygiene in milk and milk products, is presented by the Vietnam Food Administration, and is promulgated under Circular No. 31/2010/TT-BYT dated June 02, 2010 by Minister of Health.
NATIONAL TECHNICAL REGULATION FOR POWDER MILK PRODUCTS
1.1. Scope
This Regulation introduces food safety criteria and requirements for management of powder milk products, including powdered milk, cream powder, whey powder and skimmed milk powder enriched with vegetable fat.
This Regulation shall not apply to formula milk products for children aged 36 months or younger and formula milk products for special medical purposes for infants, and functional foods.
1.2. Regulated entities
This Regulation applies to:
a) Importers, manufacturers and traders in powder milk products in Vietnam;
b) Other relevant entities and individuals.
1.3. Interpretation of terms
In this document, these terms are construed as below:
1.3.1. Powdered milk
refers to milk products made by removing water from milk or adding or removing certain milk constituents without changing of the constituents or attributes of milk products as well as the whey protein to casein ratio in the initial raw milk. Powdered milk products include whole milk powder, partly skimmed milk powder and skimmed milk powder.
1.3.2. Cream powder
refers to the product resulting from the removal of water from raw cream.
Raw cream is a high-fat product in emulsion form and obtained by physically separated from milk.
1.3.3. Skimmed milk powder enriched with vegetable fat
refers to the product resulting from the removal of water from skimmed milk and the addition of vegetable fat and other food additives, if any.
1.3.5. Whey powder
refers to the product resulting from the removal of water from whey or acid whey.
2.1. Food safety criteria for powder milk products
2.1.1. Physicochemical criteria are defined in Appendix I of this Regulation.
2.1.2. Maximum limit of contaminants is specified in Appendix II of this Regulation.
2.1.3. Microbial criteria are defined in Appendix III of this Regulation.
2.1.4. The list of permissible food additives is pertinent to current regulations.
2.1.5. It is permissible to employ testing measures with precision equivalent to that of methods defined by norm in Appendix I, Appendix II and Appendix III of this Regulation.
2.1.6. Codes and full names of sampling approaches and testing methods are indicated in Appendix IV of this Regulation.
2.1.7. Ministry of Health shall regulate tests for criteria whose testing methods are not available in this Regulation according to accredited measures being employed locally or abroad.
2.2. Labeling
The labeling of powder milk products must conform to regulations in the Government's Decree No. 89/2006/ND-CP dated August 30, 2006 on product labeling and relevant written guidelines.
3.1. Declaration of conformity
3.1.1. The conformity of powder milk products imported, produced and sold domestically must be declared according to this Regulation.
3.1.2. Methods and procedures for declaration of conformity shall be governed by the Regulation on certification and declaration of conformity and conformance under the Decision No. 24/2007/QĐ-BKHCN dated September 28, 2007 by Minister of Science and Technology and the laws.
3.2. Inspection of powder milk products
The inspection of the quality and safety of powder milk products must abide by the laws.
4. RESPONSIBILITIES OF ORGANIZATIONS AND INDIVIDUALS
4.1. Importers and producers of powder milk products must announce their conformity to technical requirements in this Regulation and register such declarations of conformity with competent government authorities as defined by the Ministry of Health. Quality and safety of the products must be maintained according to such declarations of conformity.
4.2. Entities can only import, produce and sell powder milk products when they complete the registration of the declaration of conformity with competent government authorities and maintain quality, hygiene, safety and labeling in accordance with the laws.
5.1. The Vietnam Food Administration shall lead and coordinate with relevant authorities to guide and organize the implementation of this Regulation.
5.2. Vietnam Food Administration, according to its managerial duties, shall be responsible for proposing to the Ministry of Health the amendments and supplements to this Regulation.
5.3. If amendments, supplements or replacements of standards and regulations referred to in this Regulation occur, such revisions shall govern.
