PROMULGATING THE CHARTER OF PRESCHOOLS
Pursuant to the Law on Education dated June 14, 2019;
Pursuant to Decree No. 69/2017/ND-CP dated May 25, 2017 of the Government on functions, tasks, entitlements, and organizational structure of the Ministry of Education and Training;
Pursuant to Decree No. 127/2018/ND-CP dated September 21, 2018 of the Government on stipulating responsibility for state management of education;
At the request of the Director of the Department of Preschool Education;
The Minister of Education and Training promulgates the Circular on the Charter of Preschools
Article 1. The Charter of Preschools is promulgated together with this Circular.

Article 1. Scope and regulated entities
1. This Charter provides for the status, tasks, entitlements, and organization and management of preschools; organization of activities of nurture, care, and education; finance and asset; teachers and staff; children; the relationship between the school, families, and society.
2. This Charter applies to preschools, kindergartens, daycare homes (hereinafter referred to as "preschools"); organizations and individuals participating in preschool education.
Article 2. Status of preschools
A preschool is an institution of preschool education in the national education system that has its own legal status, account, and seal.
Article 3. Tasks and entitlements of preschools
1. Develop directions and plans for the development of the school according to regulations of the Ministry of Education and Training, ensuring the suitability for the socio-economic conditions of the surrounding area and the vision, mission, and core values of the school.
2. Make necessary arrangements for nurturing, caring, and educating children from 3 months old to 6 years old according to the educational program for preschools promulgated by the Minister of Education and Training.
3. Actively propose demands and participate in the recruitment of managers, teachers, and staff in public schools; manage and use managers, teachers, and staff to perform tasks of children nurture, care, and education.

5. Implement democracy and accountability of the school in managing educational activities.
6. Encourage children at preschool age to go to school; manage children; organize inclusive education programs for children with special circumstances, children with disabilities; perform preschool education universalization for 5-year-old children within the assigned scope; support other institutions of preschool education in the area to improve the quality of organization of educational activities as assigned by competent authorities.
7. Mobilize, manage, and use resources in accordance with regulations of the law; construct physical facilities according to requirements of standardization and modernization.
8. Consult with the authority and cooperate with families or caretakers of children and organizations or individuals in nurturing, caring, and educating children.
9. Facilitate managers, teachers, staff, and children to participate in appropriate activities in the community.
10. Perform other tasks and entitlements in accordance with regulations of the law.
Article 4. Types of preschools
1. Public preschools are invested in, maintained, and owned by the State.
2. People-founded preschools are invested in and maintained by local communities including organizations and individuals at hamlets, villages, communes, wards, and towns.

Article 5. Name and signboard of preschools
1. Naming of a preschool
a) A preschool name includes: “Trường mầm non/trường mẫu giáo/nhà trẻ" and the proper name. The school name is written in the establishment decision, seal, signboard, and transactional documents.
b) The proper name of the preschool must be clear and transparent, not causing misunderstandings about the organization and operation of the preschool; consistent with the nation's historical traditions, culture, morality, fine customs and traditions, and regulations on intellectual property.
2. Signboard of a preschool
a) At the upper-left corner:
- First row: People’s Committee of the district and name of the district-level unit;
- Second row: Division of Education and Training.
b) In the center: Name of the school in accordance with regulations prescribed in Clause 1 of this Article; if it is a foreign name, display below the Vietnamese name with a smaller font size. The branch name is written below the school name.

Article 6. Decentralization of state management
1. The Chairman of the People's Committee of the district shall issue the decision on establishment of a preschool. A preschool is under management of the People's Committee of the district.
2. The Division of Education and Training shall assist the People’s Committee of the district in performing the state management function on nurture, care, and education for preschools.
ORGANIZATION AND MANAGEMENT OF PRESCHOOLS
Conditions and procedures for the establishment of a public preschool or for licenses for the establishment of a private or people-founded preschool; conditions and procedures for educational activities of a preschool; merger, division, and splitting; suspension of educational activities; dissolution of a preschool shall comply with regulations of the Government on conditions for investment and operation in the field of education.
Article 8. Organizational structure of preschools
The organizational structure of a preschool includes school council, principal and vice-principal; emulation and commendation council; disciplinary committee; advisory council; Vietnam Communist Party organization, Union organization, Ho Chi Minh Communist Youth Union organization; divisions of specialities, offices; daycare homes, preschool classes.

1. School councils of public preschools
a) A school council of a preschool is the managerial organization of the school that exercises the ownership representative rights of the school and related parties; take responsibility to decide the direction of operation of the school; mobilize and supervise the use of resources meant for the school; associate the school with the community and society, ensuring the implementation of educational objectives in accordance with regulations of the law.
b) Compositions of school councils and procedures for their establishment
The composition of a school council includes the provincial secretary; principal; Union chairperson; secretary of Ho Chi Minh Communist Youth Union; representatives of divisions of specialities, offices; representative of the local government, and representative of the parent representation committee. The school council shall have a chairman, secretary, and other members. The number of members shall be an odd number, with the minimum being 7 and the maximum being 13 members.
The principal shall rely on the organizational structure, tasks, entitlements, and operations of the school council to make a list of personnel recommended by teachers and organizations or unions of the school and present it to the Chairman of the People's Committee of the district for consideration of establishment decision. The term of office of the school council is 5 years.
If there are changes in the personnel, the principal shall request a competent authority to issue supplement decisions and school council consolidation in writing.
c) Tasks and entitlements of school councils
Resolve on annual objectives, development strategies, and operation plans of the school; resolve regulations on organization and operations of the school; consider, amend, and supplement regulations of the school and present them to competent authorities for approval; resolve on the organization and personnel; resolve on policies on finance and asset use of the school.
Supervise operations of the school; supervise the process of implementing solutions of the school council and the implementation of democratic regulations in operations of the school.

The school council shall be convened for a meeting at least 3 times per year. In necessary cases or when the principal or at least one-third of the number of the school council members request, the chairman of the school council shall hold an irregular meeting to solve issues that have arisen during the performance of tasks and entitlements of the school. The school council may hold a meeting by sending questionnaires.
A meeting of the school council is valid when at least 3/4 of the members of the council attend it (including the chairman). A resolution of the school council is approved and comes into force when at least 2/3 of the members vote for it. Resolutions of the school council shall be publicly disclosed in the entire school.
The principal shall implement resolutions or conclusions of the school council on the content prescribed in Point c Clause 1 of this Article. If the principal does not agree with resolutions of the school council, he/she shall promptly and directly report and consult with the school's supervisory authority. While waiting to be consulted by the competent agency, the principal shall comply with resolutions of the school council for matters that are not against the current law and this Charter.
2. School councils of people-founded preschools
a) A school council of a people-founded preschool is the organization that exercises the ownership representative rights of the school recommended by communities that founded the school; take responsibility to decide the direction of operation, master plans, development plans, organization, personnel, finance, and asset of the school, ensuring the implementation of educational objectives in accordance with regulations of the law.
b) Compositions of school councils and procedures for their establishment
The composition of a school council includes the representative of the community, representative of the commune-level local government, persons who contribute capital to construct and maintain operations of the school. The number of members of the school council shall be an odd number with at least 3 persons.
The principal shall rely on the organizational structure, tasks, entitlements, and operations of the school council to make a list of personnel recommended by teachers and organizations or unions of the school and present it to the Chairman of the People's Committee of the district for consideration of establishment decision. The term of office of the school council is 5 years.
In case the number of members of the school number is reduced by more than 1/3 of the number prescribed in regulations on organization and operation of the school, the chairman of the school council shall hold a meeting to elect additional members for the school council within 30 days from the date of such event.

A member of the school council shall be dismissed from duty or approved for resignation when he/she sends a written request for withdrawal from the school council; has limited capacity for civil acts; has poor health for current tasks.
c) Tasks and entitlements of school councils
Develop development plans for the school in accordance with regulations of the law.
Develop regulations on organization and operation of the school; consider, amend, and supplement regulations of the school when it is necessary.
Develop and issue regulations methods, standards, and limits for revenue and expenditure of the school in accordance with regulations of the law.
Mobilize investment capital for school construction; approve annual financial estimates and final settlements and supervise the management and use of finance and asset of the school.
Nominate and request for recognition or withdrawal of recognition of the principal or vice-principal and present it to competent authorities for consideration of issuance of decisions.
Approve general plans for organizational structure and issues related to the organization and personnel of the school.
Supervise the performance of resolutions of the school council, implementation of democratic regulations in operations of the school; supervise the principal and chief accountant complying with regulations.

The school council shall be convened for a meeting at least 3 times per year. A meeting of the school council will be held when at least 2/3 of the total number of members attend it. If the number of members is insufficient as prescribed in regulations, a second meeting shall be held within 7 days from the intended date of the first meeting. In this case, the meeting will be conducted if there are more than half of the members attend it. The organization of an irregular meeting shall be decided by the chairman of the school council, but it must be agreed on by at least 1/3 of the number of members. The school council may hold a meeting by sending questionnaires.
A resolution of the school council shall be approved by votes or ballots in the meeting and comes into force when it is approved by more than half of the number of members of the school council. Resolutions of the school council shall be publicly disclosed in the school.
The principal shall implement resolutions or conclusions of the school council on the content prescribed in Point c Clause 2 of this Article. If the principal does not agree with resolutions of the school council, he/she shall promptly and directly report and consult with the school's supervisory authority. While waiting to be consulted by the competent agency, the principal shall comply with resolutions of the school council for matters that are not against the current law and this Charter.
3. School councils of private preschools
a) A school council of a private preschool is the managerial organization that exercises the representative rights of the investors and related parties; take responsibility to implement the direction of operation of the investors, master plans, development plans, organization, personnel, finance, and asset, ensuring the implementation of educational objectives in accordance with regulations of the law.
b) Compositions of school councils and procedures for their establishment
The composition of a school council includes the representative of the investors and members inside and outside the school. The number of members of the school council shall be an odd number with at least 3 persons. The term of office of the school council is 5 years.
The school council shall be elected and decided by the investors according to their capital contribution rate; the Chairman of the People's Committee of the district shall issue the decision on establishment of the school council. The board of investors shall decide on the supplement and change of the members. In case the number of members of the school council is reduced by more than 1/3 of the number prescribed in regulations, the chairman of the school council shall hold a meeting with the investors to elect additional members of the council within 30 days from the date of such event.
A member of the school council shall be discharged from duty when he/she is serving a court sentence; seriously violates regulations on the organization and operation of the school; receives written request for discharge from duty from more than half the total number of investors.

The composition of school the council of a private preschool that does not operate for profit is invested by domestic investors including representatives of investors elected and decided by the board of investors according to the capital contribution rate; members inside and outside the school. Members in the school include inherent members which is the provincial secretary, Union chairperson, and principal; elected members which is the representative of teachers and workers elected by the general conference or conference of delegates of the school. Members outside the school including representatives of managers, educators, businesspeople, and former students elected by the general conference or conference of delegates of the school.
c) Tasks and entitlements of school councils
Develop development plans for the school in accordance with regulations of the law.
Resolve the approval of regulations on the organization and operation of the school; consider, amend, and supplement regulations of the school when it is necessary.
Approve annual financial estimates and final settlements and supervise the management and use of finance and asset of the school.
Approve general plans for organizational structure and issues related to the organization and personnel of the school. Nominate and request recognition or withdrawal of recognition of the principal or vice-principal and present it to competent authorities for consideration of issuance of decisions.
Supervise the performance of resolutions of the school council, implementation of democratic regulations in operations of the school; supervise the principal and chief accountant complying with regulations.
d) Operations of school councils
The school council shall be convened for a meeting at least 3 times per year.

Article 10. Principals and vice-principals
1. Principal
a) A principal is the person who is responsible for organizing and managing operations and the quality of nurturing, caring, and educating children of the school;
b) The person who is appointed as the principal must meet the standard in accordance with regulations;
c) Principals of public preschools are appointed by the Chairman of the People's Committee of the district; principals of people-founded or private preschools are recognized by the Chairman of the People's Committee of the district. The term of office of a principal is 5 years. After 5 years, the principal will be evaluated and may be re-appointed or re-recognized. A principal may not work at a public preschool for more than 2 consecutive terms of office.
d) Tasks and entitlements of principals
Develop and organize the school apparatus; make plans and organize the implementation of plans for nurture, care, and education of the school year; evaluate the performance and report it to the school council and competent authorities; take accountability when it is necessary.

Perform management tasks of managers, teachers, and staff in accordance with regulations of the law and guidelines of education management agencies; perform etiquette principles of managers in accordance with regulations; develop plans for the development of professional capability for teachers and staff; encourage and facilitate teachers and staff to participate in educational innovation activities; participate in the recruitment and transfer of teachers and recommendation of personnel to appoint as the vice-principal.
Effectively manage and use resources of finance and asset of the school.
Receive children, manage children, and organize activities of nurturing, caring, and educating children of the school; decide on the commendation and reward.
Participate in daily activities with divisions of specialities or offices; directly participate in educational activities 2 hours per week; conduct self-study and advanced training to improve the professional capability and managerial capability; benefit from preferential allowances for teachers and preferential policies as per regulation.
Organize the implementation of democratic regulations at the school; conduct private investment in education; cooperate in organizing and mobilizing social sources to participate in educational activities, promoting the role of the school in the community.
2. Vice-principal
a) A vice-principal is the person who assists the principal in managing the school and takes responsibility before the principal and the law on the assigned tasks;
b) The person who is appointed as the vice-principal must meet the standard in accordance with regulations;
c) Vice-principals of public preschools are appointed by the Chairman of the People's Committee of the district; vice-principals of people-founded or private preschools are recognized by the Chairman of the People's Committee of the district. The term of office of a vice-principal is 5 years. After each school year, the vice-principal will receive feedback from public employees and employees in the school and evaluation from competent authorities as per regulation;

Assume responsibility to perform tasks assigned by the principal; perform etiquette principles of managers as per regulation.
Operate the school when authorized by the principal.
Participate in daily activities with divisions of specialities or offices; directly participate in educational activities 4 hours per week; conduct self-study and advanced training to improve the professional capability and managerial capability; benefit from preferential allowances for teachers and preferential policies as per regulation.
Conduct private investment in education and promote the role of the school in the community.
Article 11. Emulation and commendation councils, disciplinary councils, and advisory councils
1. Emulation and commendation council
An emulation and commendation council is established by the principal at the beginning of every school year with the principal as the chairman. Members of the emulation and commendation council include the vice-principal, provincial representation of the Vietnam Communist Party cell, Union chairperson, secretary of Ho Chi Minh Communist Youth Union, representatives of divisions of specialities and offices. The number of members of the emulation commendation council is an odd number.
The emulation and commendation council shall assist the principal in organizing emulation movements and requesting the list of commendations for managers, teachers, and staff of the school.
The chairman of the emulation and commendation council shall hold periodic meetings at the beginning of the school year, at the end of the first semester, and at the end of the school year and hold irregular meetings when it is necessary.

3. An advisory council is established by the principal based on specific requirements of each task. Tasks, entitlements, compositions, and operation time of advisory councils shall be stipulated by the principal.
Article 12. Vietnam Communist Party organizations and unions in schools
1. Vietnam Communist Party organizations in the school shall lead the school and operate within the framework of the Constitution, law, and Charter of Vietnam Communist Party.
2. Union organizations, Ho Chi Minh Communist Youth Union, and other social organizations in the school shall operate in accordance with the law and Charter of each organization in order to assist the school in achieving educational objectives.
Article 13. Divisions of specialities
1. A division of specialty includes teachers according to their daycare homes, kindergartens; cooking staff. Each division must have at least 3 members including the chief; if there are more than 7 members, there must be 1 deputy chief.
2. Tasks of divisions of specialities:
a) Rely on plans of the school to develop and plans for general operations of the division by month and school year in order to perform the educational program for preschools.
b) Conduct advanced training in terms of profession and inspect and evaluate the quality and effectiveness of nurturing, caring, and educating children; manage the use of documents, utensils, toys, and educational equipment of members of the division according to plans of the school;

3. The division of specialty shall have activities periodically at least two times per week on the principle of democracy, respect, sharing, learning, and helping each other to improve the professional capability.
Article 14. Divisions of offices
1. The members of a division of office include accountants, clerical staff, healthcare staff, treasurers, security guards, and other staff. Each division must have at least 3 members including the chief; if there are more than 7 members, there must be 1 deputy chief.
2. Tasks of divisions of offices:
a) Develop monthly and yearly operation plans of the division in order to serve the implementation of operations of the school on nurturing, caring, and educating children;
b) Assist the principal in managing the finance and asset and storing documents of the school.
c) Conduct advanced training in terms of profession and inspect and evaluate the quality and performance of members in the division according to plans of the school;
d) Participate in the evaluation and classification of members;
3. The division of office shall have activities periodically at least one time per month on the principle of democratic, respect, sharing, learning, and helping each other to improve the professional capability.

1. Children are sorted into daycare homes or kindergartens.
a) For daycare homes: children from 3 months old to 36 months old will be sorted into daycare homes. The maximum number of children in a daycare home is regulated as follows:
- A daycare home for children from 3 months old to 12 months old: 15 children;
- A daycare home for children from 13 months old to 24 months old: 20 children;
- A daycare home for children from 25 months old to 36 months old: 25 children;
b) For kindergartens: children from 3 to 6 years old will be sorted into kindergartens. The maximum number of children in a kindergarten is regulated as follows:
- A kindergarten for children from 3 to 4 years old: 25 children;
- A kindergarten for children from 4 to 5 years old: 30 children;
- A kindergarten for children from 5 to 6 years old: 35 children;

3. Each daycare home or kindergarten must have less than 2 children with disabilities who are attending inclusive education programs.
4. Each daycare home or kindergarten must have sufficient teachers as per regulation.
5. Preschools may have branches in different areas to facilitate children to go to school. Each branch is under the management of the principal or the vice-principal will be assigned to manage such branch.
ORGANIZATION OF ACTIVITIES OF NURTURING, CARING, AND EDUCATING CHILDREN
Article 16. Implementation of educational programs and development of educational plans
1. Preschools shall implement the preschool education program promulgated by the Minister of Education and Training.
2. Preschools shall reply on the educational program for preschools promulgated by the Minister of Education and Training to develop their own educational programs and organize their activities of nurturing, caring, and educating children; develop educational programs for preschools consistent with the culture, condition of the locality, the preschool, and the ability and demand of children.
3. Preschools shall implement the plan of nurturing, caring, and educating children with disabilities who are attending inclusive education programs suitable for the ability of each individual and in accordance with regulations on inclusive education programs for children with disabilities.

1. Utensils, toys, and learning materials used in preschools must be in accordance with regulations and suitable for the objective, content, and education methods according to the educational program for preschools, culture, conditions of the locality, and the ability, demand of children.
2. Preschools may select their utensils, toys, and learning materials to use as per regulation.
3. Guiding documents on nurturing, caring, and educating children with disabilities who are attending inclusive education programs must be in accordance with regulations on the inclusive education program for children with disabilities.
Article 18. Activities of nurture and health care
1. Activities of nurture and health care shall be in accordance with regulations of the educational program for preschools promulgated by the Ministry of Education and Training and regulations on school health care.
2. Activities of nurturing and caring about the health of children with disabilities who are attending inclusive education programs shall be in accordance with regulations on the inclusive education program for children with disabilities.
Article 19. Educational activities
1. Educational activities shall be in accordance with the educational program for preschools promulgated by the Ministry of Education and Training.
2. The organization of educational activities shall ensure the implementation of preschool education objectives, requirements on the content of preschool education, and requirements on preschool education methods, suitable for the development of each child and of daycare homes and kindergartens.

Article 20. Result evaluation of the nurture, health care, and education
1. Examine children's health at least 1 time per school year.
2. Evaluate the nutritional status of children on growth charts 1 time each month for children below 24 months old and 1 time every 3 months for children from 24 months old to above as per regulation.
3. Evaluate children’s growth in accordance with regulations.

1. For the school

c) Development plans of the school and plans for the nurture, care, and education by school year;

ASSET AND FINANCE OF PRESCHOOLS
Article 22. Location, scale, and area
The location, scale, and area of preschools shall comply with regulations on physical facilities of the Ministry of Education and Training.
Article 23. Physical facilities of preschools
The physical facility system of the school must at least ensure the minimum level of physical facility standard in accordance with regulations of the Ministry of Education and Training.
The school shall assume to develop specific plans and roadmaps and present them to competent authorities to increase the investment in physical facilities for maintenance and improvement in order to achieve higher levels of physical facility standard; manage and use existing physical facilities in an effective manner, avoiding waste. The school shall make periodic plans for renovation and upgrade of physical facilities as per regulation. The school shall not use expired physical facilities that have not been renovated or repaired.
Article 24. Educational equipment
1. The school shall be equipped with sufficient educational equipment; effectively manage and use such equipment in nurturing, caring, and educating children as per regulation.

Article 25. Management of finance and asset
1. The management of assets of the school shall comply with regulations of the law. Every member of the school shall preserve and protect the general asset.

Article 29. Rights of teachers and staff
1. To be respected; to have their dignity, honor, and body protected; to enjoy physical and spiritual benefits as per regulation.

3. To receive salary and allowance and other policies as per the law.
4. To be facilitated to study and attend advanced training to improve professional capability while receiving full salary, allowance according to the salary, and other policies as per regulation when appointed by competent authorities to study or attend advanced training.

1. Teachers’ standard level for training is the college diploma of preschool pedagogy. Every year, teachers shall conduct self-evaluation and receive evaluations from the school according to the professional standard of teachers; such evaluations will be used as the basis to develop plans for study and advanced training to improve the professional capability of teachers.
2. Staff's standard level for training in educational institutions is in documents on professional title standards for each job position of the staff as per regulation.
Article 31. Behaviour, etiquette, and outfits of teachers and staff
1. The behavior and etiquette of teachers and staff shall comply with regulations of the education authority and the law. Teachers and staff shall not:
a) Insult the honor or dignity or violate the body of children and colleagues;
b) Conduct unfair treatments for children;
c) Twist the educational content;

RELATIONSHIP BETWEEN THE SCHOOL, FAMILIES, AND SOCIETY
Article 35. Parent representation committees
1. A school must have its parent representation committee. Daycare homes and kindergartens must have a parent representation committee for each one.
2. The parent representation committee is organized and operates according to the Charter of parent representation committees promulgated by the Minister of Education and Training.
Article 36. The relationship between the school, families, and society
1. The relationship between the school, families, and society is meant to ensure consensus in perception as well as in activities of nurturing, caring, and educating; diversify resources to construct preschool educational institutions, ensuring the best educational environment for each child. The educational cooperation between the school, families, and society shall ensure principles of proactiveness, responsible community, democracy, equality, cooperation, and sharing.
2. The school shall proactively consult and propose the scale development and physical facility construction to the authority; organize activities of nurturing, caring, and educating. Disclose plans and results of nurturing, caring, and educating of the school and cooperation activities with parents of children; disseminate scientific knowledge about raising children for parents of children and the community; conduct children’s disease prevention and health examinations in the school.
3. Families shall proactively cooperate with the school in nurturing, caring, and educating children at home. Volunteer to contribute knowledge, effort, and materials to enhance the physical facility and actively participate in activities of the school; exercise the right of supervision for effective use of resources.

5. The school shall proactively propose assistance and acquire positive feedback of parents of children and the community about activities of nurturing, caring, and educating children of the school; pay attention to and assist families with difficult circumstances and mobilize and facilitate children to go to school.
6. The community and parents of children shall assist and supervise the school implementing activities; provide feedback for the school on activities of nurturing, caring, and educating children, activities of building a safe and friendly educational environment, and activities of improving the quality of children's nurture, care, and education.
