ESTABLISHMENT OF VIETNAM NATIONAL INNOVATION CENTER

THE PRIME MINISTER

Pursuant to the Law on Government Organization dated June 19, 2015;

Pursuant to the Government’s Decree No. 55/2012/ND-CP dated June 28, 2012, prescribing the establishment, reorganization and dissolution of public service units;

Pursuant to the Government’s Decree No. 16/2015/ND-CP dated February 14, 2015 prescribing the autonomy mechanisms of public service units;

Pursuant to the Government’s Decree No. 141/2016/ND-CP dated October 10, 2016, prescribing the autonomy mechanisms of public service units in the economy and other sectors;

Article 1. To establish the National Innovation Center that functions as a public economic unit that can self-guarantee recurrent and investment expenditures and is put under the control of the Ministry of Planning and Investment in order to support and develop the startup and innovation ecosystem, and contribute to the innovation of the growth model on the basis of science and technology development.

Its international transaction name is Vietnam National Innovation Center (abbreviated to NIC).

The NIC is headquartered in Hanoi city, locates its office premises at Hoa Lac Hi-Tech Park, has the legal personality, its stamp and is allowed to register banking accounts opened by commercial banks.

The NIC shall operate according to the autonomy mechanism under laws.

Article 2. Implementation responsibilities

1. The Ministry of Planning and Investment:

a) Setting out specific regulations on the NIC’s functions, tasks, powers and organizational structure; approving the Statutes of organization and operation of the Vietnam National Innovation Center; deciding to establish and approve the operational Rules and Regulations of the Management Board of the Vietnam National Innovation Center.

b) Mobilizing, managing and using legal resources of domestic and foreign organizations and individuals providing support for the operation of the Vietnam National Innovation Center in accordance with law. Leading and cooperating with the Ministry of Finance in reviewing and making requests to competent authorities for the use of grants or aids raised to serve the NIC’s construction and operation objectives.

c) Developing the NIC’s facilities in accordance with the law on public investment (if state budget capital is used) and relevant regulations of law.

3. The Ministry of Finance shall lead and cooperate with the Ministry of Planning and Investment in reviewing and issuing documents guiding the management and use of grants or aids to the Vietnam National Innovation Center in accordance with law.

4. People’s Committee of Hanoi city shall provide support related to location and procedures for investment and construction of the NIC’s office premises in Hanoi.

Article 3. Effect

1. This Decision shall enter into force from the signature date.

2. Ministers, Heads of Ministry-level agencies, Heads of Governmental bodies, Chairpersons of People’s Committees of centrally-affiliated cities and provinces, and other organizations and individuals involved, shall be responsible for enforcing this Decision./.
