DECREE

SUPPLEMENTING AND AMENDING A NUMBER OF ARTICLES OF THE GOVERNMENT’S DECREE NO. 81/2010-ND-CP, OF JULY 14, 2010 ON CIVIL AVIATION SECURITY

THE GOVERNMENT

Pursuant to the December 25, 2001 Law on the Organization of the Government;

Pursuant to the June 29, 2006 Law on Civil Aviation of Vietnam;

At the proposal of the Minister of Transport,

The Government promulgates Decree supplementing and amending a number of articles of the Government’s Decree No 81/2010/ND-CP , of July 14, 2010 on civil aviation security.

Article 1. Supplementing and amending clause 3, article 5 of the Government’s Decree No 81/2010/ND-CP , of July 14, 2010 on civil aviation security with the following content:

“3. Except  aircraft passengers and in emergency cases related to civil aviation security, people and vehicles entering and operating in restricted areas in airports, airfields must have civil aviation security control cards and civil aviation security control permits issued by the Civil Aviation Administration of Vietnam and related port authorities, airport or airfield operators:

a) The Civil Aviation Administration of Vietnam issues civil aviation security control cards being value to enter airports, airfields under management scope of two or more different port authorities

b) Airport or airfield operators issue civil aviation security control cards and civil aviation security control permits being value to enter airports, airfields under their management scope for officers, employees and vehicles belonging to their right of management and use

c) Related port authorities issue civil aviation security control cards and civil aviation security control permits being value to enter airports, airfields under their management scope for subjects not being stipulated in point b, clause 3 of this article;

d) The Civil Aviation Administration of Vietnam unifies with related agencies relating to issuance and use of civil aviation security control cards for officers and employees of other state management agencies in airports, airfields.”

Article 2. Organization of implementation

1. This Decree takes effect since August 01, 2012

2. Ministers, heads of ministerial-level agencies, heads of government-attached agencies, chairpersons of People's Committees of provinces and centrally run cities and related enterprises and individuals shall have responsibility for the implementation of this Decree./.
