DIRECTIVE

ON STRENGTHENING MANAGEMENT IN PRODUCTION, BUSINESS AND USE OF HELMETS WHEN JOINING IN TRAFFIC

The Government’s Resolution No. 32/2007/NQ-CP, of June 29, 2007, on urgent solutions aiming to control traffic accident, combating traffic jams, in which the provision on the helmet forcibly-wearing when joining in traffic has been agreed, supported and implemented by People.  The result has contributed a important part in minimizing quantity of dead and heavy injuries caused by traffic accidents.

However, at the present, persons joining in traffic by two-wheel motorcycles, three-wheel motorcycles and mopeds who fail to wear helmets or wear helmet improperly with specification are rather many, with a increased tendency. On the market, appearing many kinds of fake helmets; helmets with colors, designs improper with regulation, bad quality, failing to meet requirement in protection for users. Specially, the use of these helmets may increase a significant quantity of dead, and injured persons in cases of traffic accidents.

In order to correct the situation mentioned above, in serious and effective furtherance of urgent solutions aiming to control traffic accidents, combating traffic jams under the Government’s Resolution No. 32/2007/NQ-CP, and No. 88/2011/NQ-CP, the Prime Minister directs:

1. Further stepping up the campaigns, propagation, popularization, enhancing knowledges, consciousness of production facilities, enterprises and households doing helmet business in complying seriously with regulations on helmet production, import and business. Seriously handling the production, import and business of helmets which are not assured on quality, have unclear origin; affect to users' safety just for profit. 

The National Traffic Safety Committee shall coordinate with Ministries, sectors, localities, mass organizations and communication agencies in organization of propagation, campaigns for the persons joining in traffic to wear helmet properly with specification, with clear origin; fail to wear helmet with form nature, purpose just for responding regulation.

Heads of agencies, organizations, mass, enterprises are responsible for the propagation, campaigning cadres, civil servants, public employees and employees to be the good samples of compliance with provisions on use of helmet when joining in traffic.

The Ministry of Industry and Trade shall assume the prime responsibility for directing, guiding localities in strengthenning the market management, inspection, examination of helmet production, import and business in accordance with regulation. Expeditiously building and holding inspection at facilities doing helmet business, seriously handling cases of violation as prescribed by law.

The Ministry of Public Security shall direct Traffic Police Forces in strengthening inspection, handling of cases of persons joining in traffic who do not wear helmet, persons who wear helmets improperly with specifications.

People’s Committee of provinces and centrally-run cities shall direct the attached function forces in inspection, handling involving facilities doing business of fake helmets, illegal imported helmets, helmets improperly with regulations, failing to assure quality.  Having measures to handle immediately against the wide-spreading helmets sale on roads, pavements which obstruct traffic and make landscape not beautiful.

3. The ministers, the heads of the ministerial-level agencies, the heads of the Government-attached agencies, the presidents of the provincial/municipal People’s Committees are responsible for the directing, organizing implementation of this Directive and for quarterly reporting with the National Traffic Safety Committee in order to summarize and report to the Prime Minister.
