Pursuant to the Government's Decree No. 96/2008/ND-CP on August 26, 2008 defining the functions, tasks, powers and organizational structure of the State Bank of Vietnam ;
At the request of the Director of the Department of Payment;
The Governor if the State Bank of Vietnam promulgates this Circular to provide for the installation, management, operation and security of automated teller machines (hereinafter referred to as “ATMs”). 1,2
This Circular deals with the requirements, procedures, and responsibility for the installation, management, operation, and security of ATMs.
This Circular is applicable to the providers of payment services that have ATMs (hereinafter referred to as providers of payment services) and other entities that get involved in the installation, management, operation, and security of ATMs.
Article 3. Initial installation of an ATM system 3
Providers of payment services, when installing an ATM system (except mobile ATMs) for the first time, shall be responsible for:

2. Formulating internal regulations on information security, operational procedure, risk management, maintenance, control and supervision of ATMs.
3. Planning and disposing rational networks of ATMs in order to satisfy customers’ demand for withdrawal of cash.
4. Sending the schemes and documents prescribed in Clause 1, Clause 2, and Clause 3 this Article to the State Bank of Vietnam (via the Department of Payment) at least 15 days prior to the commencement of installation works.
Article 4. Installation, relocation, re-scheduling and shutdown of ATMs 4
1. Providers of payment services, when installing ATMs, shall be responsible for ensuring that the location of ATMs is convenient, adequately lit and secure for customers to carry out transactions. Moreover, electric power supplied to the booth and ATM must be subject to national standards on electrical engineering and safety. Furthermore, an ATM must be equipped with a backup power supply or be capable of returning cards to customers automatically in order to avoid the retention of customers’ cards upon in the ATM upon abrupt termination of the primary power supply.
2. A provider of payment services must send a written notice, as per Form No. 1 (for ATMs) or Form No. 2 (for mobile ATMs) enclosed to this Circular, to the relevant provincial branch of the State Bank (referred to as the branch of the State Bank) 10 working days prior to the installation, relocation, re-scheduling or shutdown of an ATM.
3. When an ATM is relocated to a different province or city, the relevant provider of payment services must notify the shutdown of such ATM in the former site and its installation in the new site.
4. Every provider of payment services must update the installation, relocation, retiming and shutdown of ATMs on its ATM management system and official website.
5. Providers of payment services shall fulfill requirements on installation and physical safety of ATMs as per regulations of the State Bank of Vietnam on the security of banks’ payment card equipment.

Providers of payment services must:
1.5 Ensure that the ATM system shall be available to customers 24 hours a day and 7 days a week. The availability of ATMs installed at sites that are only accessible to customers in certain hours shall be subject to the open time of such sites. Available hours must be displayed publicly at the sites and on the official website of the provider of payment services.
2.6 Dispose personnel to repair malfunctioned ATMs in the fastest time possible. If an ATM fails to (or expectedly ceases to) operate in over 24 hours, the relevant branch of the State Bank must be informed in the working day succeeding the date of the (expected) interruption to the ATM in over 24 hours. Moreover, customers must be informed publicly via a suitable method.
3. Maintain the customer care service 24 hours a day and 7 days a week in order to serve their customers anytime.
4.7 Cooperate with switching organizations to maintain the continuity and safety of inter-bank ATM transactions.
5. Monitor the cash fund of the ATM in order to ensure that the ATM always has cash to satisfy the demand for cash withdrawal of customers.
If an ATM is located in the urban area where the cash-supplying units of the provider of payment services are available, the provider of payment services must supply cash for that ATM in order to ensure that the no-cash period of that ATM shall not exceed 04 work hours, or not exceed 01 day if the cash is depleted after working hours. In other cases, the providers of payment services must supply cash in order to ensure that the ATMs are not depleted more than 08 working hours or 01 day if the cash is depleted after working hours.
6. Monitor, discover, and timely resolve the failed transactions, and ensure transactions must be handled accurately. Promptly provide compensations for customers if the providers of payment services’ failures, mistakes, or accidents cause damage to customers.
7. Receive, resolve, or settle the complaints or requests for checking from customers. With respect to internal ATM transactions, the time limit for checking, settling complaints and response to customers is 05 working days as from the date on which the complaints are received. For the inter-bank ATM transactions (except for international transactions), the time limit for checking, settling complaints and response to customers is 07 working days as from the date on which the complaints are received.

Article 6. Specific requirements for ATMs 9
1.10 The phone number and contact address of the operator of an ATM must be displayed publicly at the site of such ATM for customers' inquiries on transaction errors, formalities and review time or their complaints.
Instruction or symbols of payment cards accepted by an ATM must be shown at its site. Also displayed are the instruction for use of the ATM, its name or code, its services and charges. Such information may be exhibited in print or on the screen of the ATM.

3. Symbols instructing how to insert a card into the ATM must be displayed at the location of the card reader slot.
4. Both English and Vietnamese are displayed on the ATM’s screen to serve customers’ transactions.
5. A receipt printed from the ATM must be clear and legible, and may be printed in Vietnamese or English depending on each customer’s selection. A receipt must contain all of the following information: Name of the provider of payment services that installing the ATM, name or number of the ATM, type, code, date, and time of the transaction, the transacted amount, transaction fee, and ending balance (applicable to internal transactions).
6. Ways to remind customers to take their cards or cash after their ATM transactions must be implemented. If an ATM is set up to give cash before the card, the provider of payment services must instruct its customers to wait for a certain period of time to receive the dispensed cash after the ATM returns their card, in case the cash is delayed because of the slow connection.
7.12 Providers of payment services shall not limit each withdrawal at an ATM of below VND 5 million for internal transactions and below VND 3 million for inter-bank transactions.

Transaction history recorded in the ATM log must be clear and legible. The information in the ATM log must include: the name or number of the ATM, the card number, the transaction code, the date and time of transaction, the transacted amount, the number of each denomination of dispensed cash. With respect to successful transactions, the ATM log must show that cash has been dispensed from the machine.
The transaction data and history recorded in the ATM log must be integral and kept in accordance with regulations of the law on archives.
Article 7. Safety and security of ATM transactions
Providers of payment services must:
1. Comply with current regulations on the safety and security of the information technology system in banking activities. Keep the data and information of customers confidential during the processing, transmission, and storage of data.
2. Install monitoring cameras and devices to keep the ATM information from being copied or stolen within 06 months from the entry into force of this Circular.
Keep the pictures captured by the cameras for at least 100 days. In case of request for checking or complaint or when it is necessary to carry out an inspection to serve the investigation of the police agency, such pictures must be provided and kept according to the prescribed period of keeping requests for checking or complaints about the use of ATM cards of customers.
3.13 Assign guards at ATMs or cooperate with the lessors of the sites of ATMs or local security units to examine, supervise and guard ATMs.
4. Take measures for securing the PIN numbers and preventing the PIN numbers from being copied or stolen when customers are entering the PIN numbers at the ATMs.

6. Provide and encourage the use of services of controlling the transactions and account balance (such as SMS banking and internet banking services) in order to help customers supervise their own accounts.
7. Provide information and cooperate with the police and relevant organizations in the prevention of ATM-related crimes. Investigate and handle the high-tech crimes, ATM theft, robbery, and vandalism.
8. Providers of payment services shall make agreements and cooperate with each other in sharing information about ATM-related crimes in order to promptly and efficiently take preventative measures.
9.14 Fulfill other requirements for security and safety of ATM systems as per regulations of the State Bank of Vietnam on the security of banks' payment card equipment.
Article 8. Inspection and maintenance of ATMs
Providers of payment services must:
1. Formulate and implement the plans for periodical inspection and maintenance of ATMs.
2. Ensure the safety for the ATM and the cash therein during the maintenance.
3. Pay attention to the electrical safety, the prevention of fire and explosion during the inspection and maintenance of the ATMs. Find and remove the devices that are illegally installed for the purpose of stealing the card information.

Article 9. Regulations on mobile ATMs
1. Mobile ATMs are the ATMs that are able to be regularly or periodically moved to one or some other sites to serve customers within a certain period of time.
2.15 Providers of payment services, when deploying mobile ATMs for the first time, shall be responsible for:
a) Formulating the scheme to install, operate, maintain and supervise the mobile ATMs, which specifies activities (expected services, customer type). The scheme must also indicate the total quantity of mobile ATM trailers, number of ATMs in each trailer, coverage area and available time;
b) Formulating internal regulations on information security, operational procedure, risk management, maintenance, control and supervision of mobile ATMs.
c) Sending the schemes and internal regulations prescribed in Point a and Point b of this Clause to the State Bank of Vietnam (via the Department of Payment) at least 15 days prior to the deployment;
d) Informing the State Bank of Vietnam in writing of revisions to the scheme and internal regulations prescribed in Point a and Point b of this Clause prior to the adoption of such revisions.

4.17 A provider of payment services shall deploy mobile ATMs in conformity to the scheme it has sent to the State Bank of Vietnam as per universal regulations on ATMs.

6. Providers of payment services shall take measures to prevent the fake mobile ATMs, and guide their customers to identify the real one.
7.18 On quarterly basis (by the 05th of the first month of the following quarter), providers of payment services must report their deployment of mobile ATMs by using the Form No. 4 enclosed to this Circular.
Article 10. Information and reports
1. Providers of payment services and branches of the State Bank must make reports in accordance with regulations on reports and statistics adopted by the State bank of Vietnam, and irregular reports at the requests of competent agencies as prescribed by law.
2. Providers of payment services shall report the upgrade of the ATM system, the unusual issues that may entail risks and vulnerability of their ATM systems and those of other providers of payment services to the State Bank of Vietnam (via the Department of Payment).
Article 11. Responsibility of affiliates of the State Bank of Vietnam
1. The Department of Payment shall consider and cooperate with relevant units in inspecting the compliance with the requirements for the first installation of ATM network as prescribed in Article 3 of this Circular, and give opinions to any providers of payment services that fail to satisfy such requirements; receive the reports on the operation of the ATM network; cooperate with the police forces and relevant organizations in preventing ATM-related crimes; send quarterly reports on the general status to the management board of the State Bank, and send irregular reports upon the occurrence of unusual events.
2. The Offices for Banking Supervision shall inspect the compliance with this Circular of the providers of payment services; handle the violations against regulations herein under their competence, and send reports thereof to the Department of Payment.
3. Branches of the State Bank of provinces/ cities where ATMs are located shall:

b) 20 Examine and supervise local mobile ATMs and cope with violations: Examine all or some local ATMs on a periodic basis or when necessary and make ATM examination records as per the Form No. 3 enclosed to this Circular. Relevant providers of payment services' violations against regulations of this Circular, when exposed, shall be penalized intra vires.
In Hanoi and Ho Chi Minh City, the Offices for Banking Supervision shall cooperate with branches of the State Bank in examining and supervising local ATMs, tackling with violations, preventing ATM-related crimes and informing the branches of the State Bank of the result of such activities;
c) Report the difficulties and issues to the State Bank of Vietnam (via the Department of Payment) for resolving in cooperation;
d) 21 On quarterly basis (by the 05th of the first month of the following quarter), report the operations of the local ATM network via Form No. 05 enclosed to this Circular.
This Circular comes into force as of March 01, 2013.
Chief of Office, Director of the Department of Payment, heads of relevant affiliates of the State Bank of Vietnam, Directors of provincial branches of the State Bank, General Directors (Directors) of providers of payment services and relevant entities shall be responsible for implementing this Circular.

23 Articles 5, 6 and 7 of the Circular No. 30/2016/TT-NHNN providing amendments to Circulars on provision of payment services and intermediary payment services, and coming into force as of November 28, 2016, provide for as follows:
“Article 5. Effect
This Circular comes into force as of November 28, 2016.
Article 6. Transitional clause
With respect to contracts and/or agreements that are concluded before the entry into force of this Circular, providers of payment services and providers of intermediary payment services must notify their customers of new regulations on the receipt and resolution of requests for checking or complaints under the forms specified in the signed contracts/ agreements, and on their websites; carry out the conclusion of new contracts/ agreements as requested by the customers. Modification or addition to the signed contracts must be performed in accordance with regulations of this Circular.
Article 7. Implementation
Chief of Office, Director of the Department of Payment, heads of relevant affiliates of the State Bank of Vietnam, Directors of provincial branches of the State Bank, Chairpersons of the Management Boards (the Member Boards), General Directors (Directors) of providers of payment services and those of providers of intermediary payment services, and relevant entities shall be responsible for implementing this Circular./.”
