JOINT CIRCULAR
ON AMENDMENTS TO CLAUSE 5 ARTICLE 3 OF JOINT CIRCULAR NO. 41/2014/TTLT-BYT-BTC DATED NOVEMBER 24, 2014 OF THE MINISTRY OF HEALTH AND THE MINISTRY OF FINANCE ON GUIDELINES FOR HEALTH INSURANCE
Pursuant to the Law on Health insurance;
Pursuant to Decree No. 105/2014/ND-CP dated November 15, 2014 of the Government providing guidance on the Law on Health insurance;
Pursuant to Decree No. 63/2012/ND-CP dated August 31, 2012 defining the functions, tasks, powers and organizational structure of the Ministry of Health;
Pursuant to Decree No. 215/2013/ND-CP dated December 23, 2013 defining the functions, tasks, entitlements and organizational structure of the Ministry of Finance;
The Minister of Health and the Minister of Finance issue a Joint Circular on amendments to Clause 5 Article 13 of Joint Circular No. 41/2014/TTLT-BYT-BTC dated November 24, 2014 of the Ministry of Health and the Ministry of Finance on guidelines for health insurance.
Article 1. Clause 5 Article 13 of Joint Circular No. 41/2014/TTLT-BYT-BTC dated November 24, 2014 of the Ministry of Health and the Ministry of Finance on guidelines for health insurance shall be amended as follows:
“5. In case the health facility provides medical examination and treatment on weekends or holidays, it must notify the social security organization for amendments to the contract for medical services before implementation. Insured patients going for medical examination and treatment shall be covered by the healthcare fund within the limit of benefits. The medical facility shall be responsible for ensuring adequacy of staff and professional conditions and must make public all the expenses arising outside the limit of benefits and make a prior notice to the patients about such expenses that shall be paid by the patients themselves.
Article 2. Effect
This Circular comes into force from September 1, 2015.
Difficulties that arise during the implementation of this Circular should be reported to the Ministry of Health and the Ministry of Finance for consideration./.
