JOINT CIRCULAR
GUIDING THE IMPORT OF AUTOMOBILES THROUGH NON-COMMERCIAL CHANNEL BY A NUMBER OF SUBJECTS
Pursuant to the Prime Minister’s Document No. 408/CP-KTTH of May 15, 2001 on the import of automobiles through non-commercial channel by a number of subjects;
After reaching agreement with the Ministry of Finance, the Ministry of Public Security, the Ministry for Foreign Affairs and the Ministry of Communications and Transport, the Ministry of Trade and the General Department of Customs hereby jointly guide the import of automobiles through non-commercial channel by a number of subjects as follows:
I. SUBJECTS ENTITLED TO IMPORT
1. Overseas Vietnamese who are permitted to repatriate to the country;
2. Vietnamese citizens who are sent abroad for working trips, working terms or for work as specialists for 3 years or more (excluding research students, apprenticeship students, students studying abroad and laborers) by State agencies (including the National Assembly, the Government, the Supreme People’s Procuracy, the Supreme Peoples Court, the ministries, the ministerial-level agencies, and the provincial/municipal People’s Committees).
II. REGULATIONS ON THE IMPORT OF AUTOMOBILES
1. The subjects mentioned in Section I of this Circular, when finishing their overseas working term and returning to the country, or when repatriating to the country, shall be entitled to import 01 automobile which is their private property being in use overseas.

- The written request for import, with the certification of the residence address by the local administrations (for subjects mentioned at Point 1 of Section I), and the certification of the working term termination by their managing agencies (for subjects mentioned at Point 2 of Section I);
- The State body’s decision on sending them abroad for working trips, working terms, or for work as specialists, or decision of the Socialist Republic of Vietnam’s Ministry of Public Security permitting overseas Vietnamese return to and reside in Vietnam (the notarized duplicate);
- Passport (copy enclosed with the original for comparison);
- The automobile’s registration paper issued by the competent body of the host country at least 6 months before the time of return (the notarized duplicate enclosed with the notarized Vietnamese version);
- The driving license (the notarized duplicate enclosed with the notarized Vietnamese version);
- Bill of lading (3 copies, or 1 copy and 2 duplicates of the original).
3. The import automobiles must be of left-hand drive, manufactured within 5 years at most, calculated to the time of import, and have engines using non-lead petrol.
4. The subjects mentioned in Section I of this Circular must send their goods back to the country before carrying the exit procedures right from the country where they reside or work, and fulfill tax obligations according to the current law provisions when importing automobiles.
