ORDINANCE

 AMENDING ARTICLE 22 AND ARTICLE 23 OF THE ORDINANCE ON PREFERENTIAL TREATMENT FOR REVOLUTIONARY ACTIVISTS, FALLEN HEROES AND THEIR FAMILIES, WAR INVALIDS, DISEASED SOLDIERS, RESISTANCE WAR ACTIVISTS AND PEOPLE WITH MERITORIOUS SERVICES TO THE REVOLUTION
(No. 01/2002/PL-UBTVQH11 of October 4, 2002)

Pursuant to the 1992 Constitution of the Socialist Republic of Vietnam, which was amended and supplemented under Resolution No. 51/2001/QH10 of December 25, 2001 of the Xth National Assembly, 10th session.
This Ordinance amends and supplements Article 22 and Article 23 of the August 29, 1994 Ordinance on preferential treatment for revolutionary activists, fallen heroes and their families, war invalids, diseased soldiers, resistance war activists and people with meritorious services to the revolution.

Article 1.- To amend and supplement Article 22 and Article 23 of the Ordinance on preferential treatment for revolutionary activists, fallen heroes and their families, war invalids, diseased soldiers, resistance war activists and people with meritorious services to the revolution:

1. Article 22 shall be amended and supplemented as follows:

"Article 22.-

People with meritorious services to the revolution prescribed in Clause 7, Article 1 of the Ordinance on preferential treatment for revolutionary activists, fallen heroes and their families, war invalids, diseased soldiers, resistance war activists and people with meritorious services to the revolution are those who had merits in assisting the revolution during difficult and dangerous time, and were awarded by the State the "Fatherland Acknowledges the Services" badge or the "Meritorious Services" certificates, or the "Resistance War" Order or Medal.

2. Article 23 shall be amended and supplemented as follows:

1. People with meritorious services to the revolution, who were awarded by the State the "Fatherland Acknowledges the Services" badge or the "Meritorious Services" certificates, shall be entitled to enjoy monthly allowances and preferential treatment regimes like next of kin of fallen heroes.

2. People with meritorious services to the revolution, who were awarded by the State the "Resistance War" Order, shall be entitled to enjoy monthly allowances and other preferential treatment regimes as prescribed by the Government.

3. People with meritorious services to the revolution, who were awarded by the State the "Resistance War" Medal, shall be entitled to enjoy lump-sum allowances. The levels and time limits for payment of such allowances shall comply with the Government’s regulations."

Article 2.- This Ordinance takes effect as from January 1, 2003.

Other previous regulations, which are contrary to this Ordinance, are hereby annulled.

Article 3.- The Government shall specify and guide the implementation of this Ordinance.
