RESOLUTION
THE GOVERNMENT'S REGULAR MEETING - SEPTEMBER 2005
On September 28 29, 2005, the Government held its regular meeting for September 2005 to discuss and decide on the following issues:
1. The Government listened to quick reports of the Government Office and the Ministry of Agriculture and Rural Developmeant (MARD) on damages and solutions to deal with serious consequences of Storm No. 7.
Storm No. 7 with the biggest wind power over the past ten years had caused losses for coastal provinces from Quảng Ninh to Hà Tĩnh. However, by following the correct forecast, closely keeping track of the storm movements, strictly realizing preventive solutions and evacuating local people from dangerous places, having overall co-ordination with and high will of executive committees of the party hierarchy, authorities, people and people's armed forces, losses were reduced remarkably. The government appraised officials, people in provinces facing the storm and the people's armed forces that made much effort to prevent the storm, protect dykes, properties and farm produce, maintain security and stabilize people's living. The government required localities to make the best effort to stop a breach in the broken dykes, consolidate sea dykes to cope with changeable weather; restore urgently production and stabilize people's living. The MARD was assigned to direct and co-ordinate with the concerned Ministries and sectors to study and submit measures to the Government to assist localities to restore consequences caused by the storm and have specific policy to gradually strengthen sea dyke system.
2. The Government listened to the Minister of Planning and Investment presenting the Report on Implementation of Socio-economic Plan in 2005 and Investment and Development Plan in 2006; listened to the Minister of Finance presenting assessment report on State budget in 2005 and budget estimates in 2006 and budget grants in 2006.
In 2005, GDP growth estimated at 8.3-8.4% is big achievement while the economy is still facing pressing difficulties; economic structure transfer has been progressive; the quality and effectiveness of development has been raised; capital raising from the whole society has increased strongly, especially in foreign investment capital and capital from the private sector. Tax collection in 2005 and in the five year period 2001-2005 has exceeded estimates, taxation has been in progress that satisfies expenditures and strengthens national finance. All social fields have had good changes, especially poverty reduction and care of human development that has been highly appreciated by the international community. Political security, social safety and order have been stabilized. The country has entered into new opportunity with new advantages; the country's position and strength has been stronger; a stable political status has attracted foreign investors. However, the country is also facing new challenges and difficulties in the international and regional integration period.
With opportunities and advantages in 2006 stemming from achievements in the period 2001-2005 and social-political stability as well as potential geopolitics and geo-economics, GDP growth can reached 8% and more.

- The Ministry of Planning and Investment (MPI), the Ministry of Finance should co-ordinate with the Ministry of Transport, the MARD to propose measures and arrange funds to clear all debts of capital construction in order to remove difficulties for enterprises and banks.
- For poor provinces assisted by funds of capital construction by the Central Government, they must ensure enough corresponding capital. The MPI must study to set up the Fund of ODA corresponding capital at the Central level to meet provinces' demands and push up the speed of budget release.
- The proportion of the poor according to the new poor standards has been increasing. As a result, in the plan of 2006, there must be mobilized strength of the political system and all society to deal with poverty reduction. The Government will infuse more capital into the Social Policy Bank. It will co-ordinate with the Vietnam Fatherland Front and people's organizations to help people develop production and eliminate hunger and reduce poverty.
- The Ministry of Finance must re-estimate the revenues from crude oil and co-ordinate with localities to prevent losses of revenue, increase revenue for 2006 budget to deal with the needs as raised by the Cabinet members and try to increase backup budget to about 4%.
The MPl, Ministry of Finance must complete the Report with the above opinions, and then submit it to the National Assembly.
3. The Government listened to the Minister of Health presenting the Action Program of the Government on realizing Resolution 46-NQ/TW dated February 23, 2005 of the Politburo on protecting, taking care of, and raising people's health in the new situation.
On February 23, 2005, the Politburo issued Resolution 46-NQ/TW on protecting, taking care of, and raising people's health in the new situation. The Resolution is the orientation that helps the government to give policy and develop the task of protecting, taking care of and raising people's health. The target of the Government's Action Program is to set out tasks and solutions to apply the Resolution; assign clearly responsibility to ministries, sectors and people's committees at all levels and co-ordination between Vietnam Fatherland Front and people's organizations in realizing these in practice; make clear progress in protecting, taking care of and raising people's health that shows consistently the view of sustainable development: Economic growth with social equality and care-taking of humans.
The Ministry of Health was assigned to direct and co-ordinate with the Government Office and relevant agencies to collect opinions in the meeting, complete the draft Action Program of the government in realizing the Resolution of the Politburo, then submit it to the Prime Minister for consideration and issuance.
4. The Government listened to the Minister of Education and Training presenting adjustment of tuition fees in education units under the national education system; listened to the Minister of Health presenting adjustment of hospital fees.

5. The Government listened to the Minister of Resources and Environment presenting issuance procedures of the Government's Resolution on adjusting plans of land use of provinces and cities, the Ministry of National Defense and the Ministry of Public Security.
The consideration and adjustment of plans of land use of provinces and cities, the Ministry of National Defense and the Ministry of Public Security must follow the Government's authority according to regulations of the Land Law, at the same time, procedures must be made quickly and in good order that satisfies the needs of plan management and the land use plans.
The Government Office was assigned to direct and co-ordinate with the Ministry of Resources and Environment to urgently take all comments of Cabinet members, complete the draft Resolution on considering and adjusting plans of land use, then submit it to the Prime Minister to sign before making public.
6. The Government listened to the Minister of Justice making a report on studying, collecting opinions for completing the Bill on Real Asset Registration (which was discussed and offered suggestions by the Government in the regular meeting in August 2005); listened to the Minister of Health presenting the bill of human organs donation and tissue transplant; listened to the Government Office making a report on this bill after summing up ideas of Cabinet members.
a) The Bill on Real Asset Registration has been amended according to the Government's Resolution of August 2005 meeting after summing up opinions in the meeting that shows the spirit of administrative reform, performs one certificate, one registration body, ensure legality and advantage for the owner of land and property attaching to land. The Minister of Justice by order of the Prime Minister will submit it to the Standing Committee of the National Assembly.
b) The Bill of Human Organs Donation and Tissue Transplant stems from big and increasing demands of human organs donation and tissue transplant and makes legal basis for human organs donation and tissue transplant for purposes of humanity, treatment of people, scientific research and teaching, the Bill must show itself the respect of rights of people's records, the voluntary for humanity purposes, ensuring medical morality, and keep in secret of information and conform with related legal documents.
c) The Government agreed and approved the Bill of Human Organs Donation and Tissue Transplant. The Minister of Health by order of Prime Minister will submit it to Standing Committee of the National Assembly.
7. The government listened to the Minister of Finance making a report on issuance of Government bond to the international market in 2005; listened to the Government Office making a report after collecting opinions of Cabinet members on the draft Decree that governs emulation and rewards and the draft Decree to replace Decree 90/1998/NĐ-CP dated November 07, 1998 on Management Regulations of taking out and repaying foreign loans.
a) The Government agreed on the issuance of Vietnam Governmental bonds to the international market according to Decision 914/2005/QĐ-TTg dated September 01, 2005 by the Prime Minister. The Government empowered the Minister of Finance who can authorize other entity to sign legal documents relating to international bond issuance with terms conforming to international general rules and decide all conditions and terms of the bond.

b) For the draft Decree on emulation and reward, the Government affirmed that it is necessary to have a simple, flexible, effective mechanism that is responsible for this work, not rigidly set up a fixed organizational model in Ministries, ministry-leveled agencies, agencies under the government, provinces and cities under the Central Government. Basing on requirements and tasks of sectors and localities, it is flexible to authorize to Ministers, heads of ministerial-level agencies, heads of governmental agencies and People's Committees in centrally-administered cities and provinces to decide or submit to the authorized bodies for decision on the establishment of emulation and reward machinery.
The Government Office was assigned to direct and co-ordinate with the Central Emulation and Reward Board to urgently complete this draft Decree, then submit it to the Prime Minister to sign for issuance.
c) For the draft Decree to replace Decree 90/1998/NĐ-CP dated November 07, 1998 on issuing Management Regulations of taking out and repaying foreign loans, the Government assigned the Government Office to complete procedures and then submit to the Prime Minister to sign for issuance. Under the draft decree, foreign loans for local authorities will be borrowed by the Government that will then lend them to local localities.
The Government considered reports on the implementation of the social-economic plans in September and the first nine months in 2005, listened to the Minister of Planning and Investment presenting actions taken in the last months of the same year; listened to the Minister of Trade presenting the commercial situations in September and the first nine months in 2005.
The commercial situations in September and the first 9 months in 2005 have had progress. Average GDP growth in the first nine months has reached 8.1%. To successfully complete the 2005-year plan, the Government required Cabinet members, heads of ministerial-level agencies, heads of governmental agencies and People's Committees in centrally-administered cites and provinces to spend time to follow closely grassroots authorities, settle difficulties, push up production and export; speed up disbursement for capital construction; deal with well social-cultural problems, poverty reduction, maintain social security and safety, and reduce traffic accidents. The ministries and sectors must closely inspect and help localities that suffered from Storm No. 7 and flood, not let people in hunger and diseases; help people stabilize their living, restore production, keep environmental sanitation, repair people's houses and infrastructure after storm and flood./.
