RESOLUTION

APPROVING INVESTMENT GUIDELINES OF NATIONAL TARGET PROGRAM FOR SOCIO-ECONOMIC DEVELOPMENT OF ETHNIC MINORITY AND MOUNTAINOUS AREAS IN 2021 - 2030 PERIOD

THE NATIONAL ASSEMBLY

Pursuant to the Constitution of the Socialist Republic of Vietnam;

Pursuant to the Law on Organization of the National Assembly No. 57/2014/QH13;

Pursuant to the Law on Public Investment No. 39/2019/QH14;

Pursuant to the Law on State Budget No. 83/2015/QH13;

Pursuant to the National Assembly’s Resolution No. 88/2019/QH14 dated November 18, 2019 on approval of master plan for socio-economic development of ethnic minority and mountainous areas in 2021 - 2030 period;

HEREBY RESOLVES:

Article 1.

Investment guidelines of National target program for socio-economic development of ethnic minority and mountainous areas in 2021 - 2030 period (hereinafter referred to as “the Program) are approved. To be specific:

1. Duration of the Program: 10 years divided into 2 phases:

- Phase I: From 2021 to 2025.

- Phase II: From 2026 to 2030.

2. Objectives of the Program: Gradually narrow the gap between the ethnic minority and mountainous areas’ living standards and income and the national average income; reduce the number of extremely disadvantaged communes, villages and hamlets by 50% by 2025 and 100% by 2030.

3. Funding for executing the Program:

a) Total capital for the 2021 - 2025 period: at least 137,664 billion dong, including:

- Local government budget: 10,016 billion dong;

- Policy-based loan capital: 19,727 billion dong;

- Other legal capital raised: 2,967 billion dong.

b) The Program’s capital included in the medium-term investment plan in 2021 - 2025 period.

c) According to result of execution of the Program in 2021 - 2025 period, the Government shall request the National Assembly to decide the resources for execution of the Program in 2026 - 2030 period.

4. Rules and main solutions for executing the Program:

a) Make investment in a focused, targeted and sustainable manner, give focus to the most disadvantaged communes, villages and hamlets; solve the most pressing and urgent problems; give preferential support to poor households and the most disadvantaged ethnic groups.

b) Ensure publicness and democracy, promote the right to mastery of and active participation by the community and people; promote perseverance of ethnic minorities.

c) Give local governments authority to design and organize execution of the Program in a manner that suits the conditions, characteristics, potential, strengths, cultural identity and good customs of ethnic groups and regions in association with national defense and security strengthening.

dd) Strengthen the inspection, supervision and assessment of execution of the Program at all levels. Prevent acts of misconduct during execution of the Program.

Article 2.

The Government is assigned to undertake the following tasks:

1. Carry out review of the National target program for new rural construction, National target program for sustainable poverty reduction and 21 target programs which are being executed, thereby determining contents and regulated entities of the Program and area where the Program is executed in such a manner the programs do not overlap with each other. Study and apply policies suitable for characteristics and infrastructure of ethnic minority and mountainous areas of 02 national target programs and target programs that are being executed to be included in this Program. Make sure that top investment priority is given to the most disadvantaged localities.

2. Provide directions on preparation of a feasibility study report according to viewpoints, objectives, scope, entities, contents, tasks, solutions and management mechanism specified in the Resolution No. 88/2019/QH14 dated November 18, 2019 of the National Assembly on approval of master plan for socio-economic development of ethnic minority and mountainous areas in 2021 - 2030 period. Focus on providing investment resources to solve urgent issues of ethnic minority and mountainous areas in the order of priority: by 2025, basically tackle the shortage of houses, residential land, production land and domestic water; stably establish settlements in extremely disadvantaged areas, especially areas at high risk of natural disasters; develop agricultural and forestry production, make sure that people have stable income from forest protection and development, protect sustainable livelihoods; make investment in essential infrastructure; focus on developing education and training and improving the quality of human resources; take good care of people's health and prevent child malnutrition; maintain national defense, security, and national border sovereignty; pay attention to the communication, praise and honor good characters; consolidate and strengthen the great bloc of national unity.

3. Decide to invest in the Program in accordance with regulations of the Law on Public Investment; prescribe special mechanisms for organizing management and execution of the Program which are appropriate to ethnic minority and mountainous areas. Promulgate criteria for determining ethnic groups still encountering many difficulties or special difficulties.

4. During its direction, the Government shall continue to review and balance central government budget and provide budget transfers to the Program in a manner that increases investment development expenditures, provides assistance in increasing policy-based loan capital and produces appropriate solutions for seeking ODA and investment from economic sectors and private capital for the Program.

5. The Government shall submit an annual report on execution of the Program to the National Assembly at the year-end meeting. By 2025, review the Program in phase I and request the National Assembly to consider and decide the execution of the Program in Phase II from 2026 to 2030.

Article 3.

1. Make a budget estimate and allocate their local government budget in an appropriate manner as well as central government budget and mobilize other resources for execution of the Program.

2. The provincial People’s Committee shall submit an annual report on execution of the Program to the provincial People’s Council and the Prime Minister.

Article 4.

The National Assembly's Standing Committee, Ethnic Minorities Council, Committees of the National Assembly, National Assembly’s deputy delegations and deputies, member organizations of the Vietnamese Fatherland Front shall, within their jurisdiction, supervise the execution of the Program.

This Resolution was ratified by 14^th National Assembly of the Socialist Republic of Vietnam in its 9^th session on June 19, 2020.
