CIRCULAR
Pursuant to Law on vocational education dated November 27, 2014;
Pursuant to the Government's Decree No. 14/2017/ND-CP dated February 17, 2017 defining functions, tasks, powers and organizational structure of the Ministry of Labor, War Invalids and Social Affairs;
Pursuant to the Government's Decree No. 143/2016/ND-CP dated October 14, 2016 on conditions for investment and operation in vocational education sector;
At the request of Director General of General Department of Vocational Education,
The Minister of Labor, War Invalids and Social Affairs promulgates a Circular on regulations of enrollment and determination of enrollment targets at intermediate and college level
GENERAL PROVISIONS
1. This Circular deals with regulations of enrollment, including: Time, eligible candidates, and forms of enrollment; contents of regulations on enrollment; procedures and application for admission at intermediate or college level; organizational structure, composition, duties and entitlements of Admission Council; organizational structure, composition, duties and entitlements of Secretary Board of Admission Council; enrollment by assessment or examination, or a combination of assessment and examination; secondary check; determining cut-off marks; convene successful candidates; inspecting assessment or examination results and dossiers of successful candidates; using information technology and communications in enrollment activities; processing reports on violations against Regulations of enrollment; commendation and taking actions against violating staff in charge of enrollment; rights and responsibilities of principals; responsibilities of candidates in enrollment period; taking actions against violating candidates; reporting and archives.
2. This Circular provides for the determination of enrollment targets, including: criteria, rules for determining targets, procedures for registration and notification of enrollment targets.
1. This Circular applies to junior colleges, vocational training schools and senior colleges/universities that have registered for provide training at college level (hereinafter referred to as schools) and relevant agencies, organizations, and individuals as prescribed.
2. This Circular does not apply to any candidates applying for studying foreign-associated education programs and studying abroad.
REGULATIONS OF ENROLLMENT
Article 3. Time, entities, and forms of enrollment
1. The enrollment shall be administered one or multiple times in a year.
2. Eligible candidates:
a) At intermediate level: Lower secondary graduate students and higher;
b) At college level: Upper secondary graduate students and higher;
c) Officials and civil servants, employees working at state-owned agencies, units, enterprises, political organizations, socio-political organizations; soldiers, people's police on service; foreigners that satisfy the conditions for applying for admission at intermediate or college level:
- Satisfy the conditions prescribed in Point a and b Clause 2 of this Article;
- Officials and civil servants, employees (if their study costs are financed by state budget) working at state-owned agencies, units, enterprises, political organizations, socio-political organizations; soldiers, people's police on service; foreigners that satisfy the conditions for applying for enrollment at intermediate or college level with consent of the heads of competent authorities;
- Soldiers and people’s polices on service shall be eligible for applying for enrollment in schools prescribed by the Ministry of National Defense or the Ministry of Public Security with consent of competent authorities; soldiers on service whose military service is almost expired as prescribed, If approved by the head of regimental level upwards, they may apply for enrollment subject to their individual expectation; in case of passing the examination, they must conduct matriculation in such year without reservation for the next academic year;
- With regard to a candidate being foreigner who wishes to study a vocational training school or a junior college in Vietnam: The Principal shall, according to his/her performance in lower secondary school, upper secondary school, or higher (academic transcripts, diplomas, evidence certificates) and results of examinations on knowledge or Vietnamese (if necessary) as prescribed by the school to consider admitting such candidate to the school.
3. Enrollment forms include:
a) Assessment;
b) Examination;
c) Combination of assessment and examination.
Article 4. Contents of Regulations of enrollment
Regulations of enrollment shall be formulated by schools themselves, at least containing: major; enrollment duration; eligible candidates; enrollment forms; enrollment incentives, including: eligible candidates, areas; direct admission, priority score frame, etc. (refer to Appendix 01); conditions for ensuring quality of successful candidates (if any); enrollment fees; conditions for implementing enrollment plan, including: personnel, facilities, equipment; enrollment plan and enrollment announcement; inspection, overseeing and handle claims and denunciation; reporting; commendation, disciplinary actions; other relevant matters (if necessary).
Article 5. Procedures and application for admission at intermediate level or college level
1. Application
a) A candidate shall, according to the enrollment plan of a school, apply for admission in a major of the school in conformity with his/her expectation, capacity and conditions;
b) The candidate may apply for admission in one or multiple schools by through application form
The application form shall be issued by schools and posted on their website, at least containing the following of a candidate: Full name; date of birth; race; permanent residence; place of study in each academic year of upper secondary schools/lower secondary schools; major applied for; priority entity; mailing address, etc.
2. An application shall consist of:
a) An application form;
b) Valid copies of necessary documents subject to requirements and criteria for assessment or examination of each school.
3. Submission procedure and enrollment fees: Each school shall make public submission procedure and enrollment fees; candidates may submit applications and pay enrollment fees directly, online or by post.
Article 6. Organizational structure, composition, duties and entitlements of Admission Council
1. The school’s Principal shall issue a decision on establishment of Admission Council to manage the work relating to the enrollment activities.
2. Composition:
a) President: Principal or Deputy Principal;
b) Deputy President: Deputy Principal or Head of Training Department;
c) Standing member: Head or Deputy Head of Training Department (or of Testing Department, Unit in charge of enrollment subject to the Principal’s decision);
d) Members: Heads, Deans, Subject Heads, teachers – lecturers and information technology staff decided by the Principal.
3. Duties and entitlements of Admission Council:
a) Initiate chosen enrollment plans;
d) Deal with queries and claims and denunciation in respect of enrollment activities;
c) Collect and use enrollment fees as prescribed;
d) Summarize the enrollment process; decide commendation or disciplinary actions as prescribed;
dd) Use the single software of the school; promptly send reports on enrollment activities to the Ministry of Labor, War Invalids and Social Affairs (General Department of Vocation Education) and Service of Labor, War Invalids and Social Affairs.
4. Duties and entitlements of President of Admission Council:
a) Take charge and responsibility for enrollment activities of the school; send reports on implementation and results of enrollment activities after a particular enrollment;
b) Send reports on enrollment activities to the Ministry of Labor, War Invalids and Social Affairs (General Department of Vocation Education) and Service of Labor, War Invalids and Social Affairs;
c) Establish assistance boards to the Admission Council so as to initiate enrollment activities, including:
- Secretary Board; Secondary Check Board; Test Board, Invigilation Board, Examination Board (specialization boards), subject to the enrollment method of each school;
- Other boards (if any) prescribed by the President of Admission Council with reference to Admission Council members.
Organizational structure, number, composition, functions, tasks, powers of assistance boards of Admission Council prescribed by the President of Admission Council with reference to Admission Council members. Specialization boards are entitled to perform duties as prescribed in the Regulations of enrollment promulgated by the Principal and publicly posted on the school’s website.
5. The Deputy President of Admission Council shall perform duties assigned by the President of Admission Council and deal with the work on behalf of the President of Admission Council if authorized.
Article 7. Organizational structure, composition, duties and entitlements of Secretary Board
1. Composition of Secretary Board:
a) the Head cum the Standing member of Admission Council;
b) Members: Staff members of Department of Enrollment or Department of Training or Department of Test, faculties, divisions and information technology staff.
2. Duties and entitlements of Secretary Board (if the school applies method of assessment for enrollment):
a) Receive applications and fees for application for assessment;
b) Insert and check information about applications for assessment to the enrollment software of the school;
c) Update and make public information about applications for assessment;
d) Make an intended plan for cut-off marks, and submit it to Admission Council for decision;
dd) Make a list of successful candidates;
e) Print and send invitations to successful candidates;
g) Check applications of successful candidates as prescribed in Article 11 of this Circular;
h) Propose the Principal or the President of Admission Council to amend Regulations of enrollment of the school applying assessment for enrollment in conformity with the reality of each enrollment;
i) Perform other duties assigned by the President of Admission Council.
3. Duties and entitlements of Secretary Board (if the school applies method of assessment for enrollment or combination of examination and assessment):
a) Make public application forms, time, and location relating to the application for taking exams on the school’s website and other means of mass media;
b) Receive applications and fees for application for taking exam;
c) Insert and check application for assessment to the enrollment software of the school;
d) Update and make public information about applications for examination;
e) Print and send notices of taking exam;
g) Enable candidates to take exams, receive exams from Invigilation Board, store and inventory exams, handover candidates’ exams to Examination Board;
h) Manage applications and documents, records relating to examination or assessment;
i) Make an intended plan for cut-off marks, and submit it to Admission Council for decision;
k) Make a list of successful candidates;
l) Print and send notices of exam results, invitations of successful candidates to be admitted;
m) Check applications of successful candidates as prescribed in Article 12 of this Circular;
h) Propose the Principal or the President of Admission Council to amend Regulations of enrollment of the school applying method of examination or combination of examination and assessment for enrollment in conformity with the reality of each enrollment;
o) Perform other duties as prescribed by the President of Admission Council.
Article 8. Enrollment in the form of examination or combination of examination and assessment
The enrollment in the form of examination or combination of examination and assessment shall ensure the following:
1. Requirements for contents of exams:
a) The contents of exams shall be consistent with the general level of candidates, the requirements for classification of candidates’ learning capacity and the allotted time specified in each exam subject;
b) The contents of exams shall satisfy the requirements for testing basic knowledge, ability to use and practical skills of candidates to the extent required by the upper secondary program (mostly in grade-12 program), and regulations on amendments to contents of upper secondary schools;
c) The contents of exams shall be prepared scientifically, accurately, closely, clearly, and free of errors;
d) Aptitude tests and other particular tests shall be consistent with Regulations of enrollment promulgated by the Principal.
2. Administration the invigilation, grading, and review grading shall be consistent with the Regulations of enrollment and regulations of this Circular.
1. Time limit for secondary check:
a) The Admission Council shall receive applications for secondary check of assessment results within 15 days from the date on which the assessment results and successful candidates are announced. The Admission Council shall give responses to the applications no later than 10 days from the date of receipt;
b) A candidate shall file a claim for the score and pay fees subject to the school's regulations. If any errors are indentified, during the grading review, the Admission Council shall refund the fees to the candidate.
2. Administer secondary check:
a) The secondary check shall be administered directly by the President of Admission Council. Members participating in the process of inserting the score and inspecting in previous grading must be absent in the composition of the secondary check group; time and working location shall be defined by the President of Admission Council;
b) Before the secondary check is conducted, the Secretary Board (at least 2 persons) shall follow the following procedures:
- Take preliminary inspection of applications of candidates, in case of any unusual matters in the application of a candidate, a record shall be made and sent to the President of Admission Council;
- Make a transfer note and handover applications for examination of candidates who apply for secondary check to the President of Admission Council.
c) When the secondary check of candidates is conducted, the secondary check group (at least 2 persons) shall follow the following procedures:
- Check the condition of candidates’ applications for examination;
- Collate the notices of results sent to the candidates who have applied for the secondary check and their respective applications for examination;
- Send a report on the collation of the notices of results sent these candidates.
d) Processing secondary check results:
- If the results of assessment or examination after the secondary check are similar to the applications for examination, they shall be confirmed by the head of secondary check group as official results;
- If the results of assessment or examination after the secondary check are different from the applications for examination, these applications for examination shall be withdrawn and given to the head of the secondary check group for considerating, amending appropriately, making records and storing those applications;
- If a candidate becomes successful, according the secondary check results, the President of Admission Council shall determine reasons for errors and take actions in case of any evidence of violations as prescribed in this Circular.
dd) Giving secondary check findings:
- The secondary check results signed by the head of secondary check group shall be considered official;
- The amended results shall be decided by the President of Admission Council and sent to the candidates applying for secondary check.
Article 10. Determination of cut-off marks
1. According to the targets being determined as prescribed with a deduction of candidates to be directly admitted and candidates nominated to be admitted (if any); enrollment result statistics; regulations on priority score frame (if any), the Secretary Board of Admission Council shall make intended admission plans to be submitted to the Principal or the President of Admission Council for consideration.
Schools may formulate standards for successful candidates whether within the scope of school or in particular majors subject to the decisions of the President of Admission Council.
2. If the number of successful candidates assembling at the school is insufficient as specified in the invitations, the school may lower the enrollment standards or conduct additional enrollments until the targets are met. The decision on lowering enrollment standards and conducting additional enrollments shall be made by the Principal or the President of Admission Council with reference to Admission Council members and made public on the school’s website or other means of mass media.
3. If the number of candidates assembling at the school for admission is sufficient as determined in the next enrollment, the school may not receive any application for examination further even if there are following enrollments as specified in the prior notices and make public on the school’s website or other means of mass media.
The standards for all enrollments of the school are not necessarily similar and subject to the decision of the Principal or the President of Admission Council with reference to Admission Council members.
4. If the targets for some majors have not been met, although the standards for these majors have lowered to the limit required by the school, the school may choose unsuccessful candidates in other majors that satisfy the standards of the former majors and voluntarily choose these majors. If the number of qualified candidates exceeds the target, they shall be sorted out in descending order until the number is sufficient according to public procedures.
5. According to plans for determining enrollment standards proposed by Secretary Board with reference to Admission Council members, the Principal or the President of Admission Council shall decide, take responsibility, and approve the conditions for successful candidates providing that the number of successful candidates to be admitted does not exceed 10% of the target being determined the school’s certificate of registration for vocational educational operation. Conditions for successful candidates, and the list of successful candidates must be publicly posted on the school’s website or other means of mass media.
Article 11. Assembling successful candidates
1. The Principal or the President of Admission Council shall directly approve the list of successful candidates submitted by the Secretary Board and sign successful candidates to be admitted. The invitation of admission sent to a candidate shall specify his/her examination results and necessary requirements for admission.
2. A student shall, before entering the school officially, undergo a comprehensive check-up taken place by the school. The check-up must be taken place in accordance with regulations of the Ministry of Health and the Ministry of Labor, War Invalids and Social Affairs. If the school does not establish a check-up council, candidates shall undergo check-ups at health facilities eligible for issue health certificates as prescribed by the Ministry of Health. The health certificate issued by the health facility or check-up council of the school shall be included in the records of students.
3. Each successful candidate must submit the following documents:
a) Valid copies of diploma and academic transcripts of upper secondary school (complementary upper secondary school) or lower secondary school (subject to the candidate);
b) A temporary graduation certificate if the candidate is successful in the year in which he/she graduates or a valid copy of graduation certificate if the candidate graduated previously. Any candidate obtaining the temporary graduation certificate shall, at the begin of the following academic year, present the original of graduation certificate for collation;
c) Valid copies of birth certificate and permanent residence book;
d) Valid copies of evidence for the eligibility to enjoy incentives prescribed in guiding documents of the Ministry of Labor, War Invalids and Social Affairs;
dd) Invitation of admission.
Those documents prescribed in Points a, b, c, d, and dd of this Clause shall be used by the school for management and collation with original copies whenever necessary.
4. If a candidate presents at the school for admission 15 days behind schedule as specified in the invitation of admission, the school is entitled to refuse such candidate. If the candidate presents late due to any of the following force majeure events: sickness, accidents, natural disasters with certification of at least a district-level hospital or district-level People’s Committee, the school shall consider admitting such candidate or reserving the enrollment results to enable such candidate to enter the school next course.
5. Any successful candidate that is retained and prevented by the local government from entering a school is entitled to file a claim to competent authorities as prescribed in the Law on complaints and denunciation.
Article 12. Inspecting results of assessment or examination and documents of successful candidates
1. After an enrollment, the school shall inspect the results of assessment or examination of successful candidates in all stages, and compare their originals and copies of candidates' documents. If any violation against the regulations is detected or in case of suspected matter, a report shall be sent to the Principal or the President of Admission Council for verification.
2. When candidates entering the school for admission, the school shall inspect their documents as prescribed in Clause 3 Article 11 hereof.
During the study progress of a student, in case he/she files any claim or denunciation, the school shall inspect such claim/denunciation and inspect his/her documents and examination results as prescribed.
Article 13. Using information technology and communications in enrollment activities
Each school shall assign qualified staff in charge of information technology to prepare sufficient computers, printers, create email addresses, and strictly follow structure, process, and deadline for processing enrollment data, in particular:
1. Insert candidates’ applications for examination, insert data about prequalification results (if any).
2. Print notices of acceptance for successful candidates, specifying the candidates’ examination results.
3. Update applications for examination and publish the list of successful candidates on the school’s website and means of mass media.
Article 14. Processing information about violations against Regulations of enrollment
1. Contact points of information or evidence of violations against Regulations of enrollment:
a) Admission Council;
b) Inspectorate of vocational education.
2. Evidence of violations against Regulations of enrollment of which the authenticity has been verified shall be the basis for dealing with violating entity.
3. Provide information and evidence of violations against Regulations of enrollment:
a) If any person, including candidates and people participating in enrollment activities, detects any of the violations against Regulations of enrollment, he/she shall provide information for the contact point prescribed in Clause 1 of this Article for timely handling as prescribed in law on denunciation;
b) The person providing information and evidence of violations against Regulations of enrollment shall take legal responsibility for their authenticity and may not misuse them to prejudice the enrollment activities.
4. The contact point of information or evidence about violations against Regulations of enrollment shall:
a) Receive information or evidence as prescribed; keep the evidence unchanged; and verify their authenticity;
b) Initiate measures for preventing misconducts, violations against Regulations of enrollment as provided;
c) Take actions within its competence or send reports to competent authorities for handling and make public the handling results;
d) Protect information and identification of the person providing information.
1. A person who has made many contributions, actively accomplished excellently the assigned task of enrollment, depending on the specific achievements, is rewarded by the Rector and the President of Admission Council in accordance with the provisions of the Law on Emulation and Commendation.
2. The commendation fund shall be appropriated in enrollment fees.
Article 16. Taking actions against violating staff in charge of enrollment
If a staff member in charge of enrollment violates the regulations (detected when he/she is on duty or after the enrollment), he/she shall be, in case of sufficient evidence and depending on nature, taken actions prescribed in the Law on employees and the Law on officials and civil servants, documents on disciplinary actions against officials and civil servants, and relevant documents by his/her superior authority.
Article 17. Rights and responsibilities of the Principal
1. The Principal has right to decide number of enrollment in a year and form of enrollment.
2. The Principal shall formulate the schools’ regulations of enrollment and make public on the school’s website and other means of mass media.
3. Forms of actions against violations shall be decided by the Principal in accordance with the school’s Regulations of enrollment and regulations of law.
Article 18. Responsibilities of candidates in enrollment
1. Make accurate declaration, submit sufficient application and pay full enrollment fee to the school for which the candidate applies for, and present at the school on time as required by the school.
2. When a candidate applies for aptitude examination, he shall fulfill responsibilities both prescribed in this Circular and in regulations stipulated by the school that administer the aptitude examination.
3. The candidate shall take responsibility for the authenticity of the application for taking examination. The school may refuse to admit or expel the candidate from the school if he/she does not satisfy conditions for admission when collating the application for taking examination and the original.
4. Detect and denounce violations against Regulations of enrollment to the Admission Council for handling.
Article 19. Taking actions against candidates violating Regulations
If any candidate violates Regulations, a record shall be made and he/she shall, depending on the extent of violation, be disciplined in accordance with Regulations and liable for penalties according to current regulations.
Subject to the extent of violation, the Principal shall decide any of disciplines: reprimands, warnings, suspension, deprivation of right to admission, etc. as prescribed in Regulations of enrollment and in accordance with regulations of law in force.
1. Schools shall send quarterly reports on enrollment plans and results to their governing bodies, Services of Labor, War Invalids and Social Affairs before 25th of the last month of a quarter.
2. The governing bodies and Services of Labor, War Invalids and Social Affairs shall send consolidated reports to the Ministry of Labor, War Invalids and Social Affairs (via General Department of Vocational Education) before the 30th of the last month of a quarter.
All documents in connection with the enrollment, results and enrollment documents shall be archived or invalid documents shall be destroyed as prescribed in the Law on archives.
DETERMINATION OF ENROLLMENT TARGETS
Article 22. Criteria for determining enrollment targets, including:
1. Rate or students, student-teacher ratio, student-lecturer ratio of each major shall be determined as prescribed in Point d, Clause 2, Article 14 of Decree No. 143/2016/ND-CP dated October 14, 2016 of the Prime Minister on conditions for investment and operation in vocational education sector.
2. Training facilities and equipment in conformity with majors, scope, and training levels shall be determined according to Point b, Clause 2, Article 14 of Decree No. 143/2016/ND-CP dated October 14, 2016 of the Prime Minister on conditions for investment and operation in vocational education sector.
3. The time for determining data is every December 31.
Article 23. Rules for determining enrollment targets
The Principals may exercise autonomy in determining annual enrollment targets and types of levels in the same major, providing that all criteria prescribed in Article 22 of these Regulations shall be met in accordance with regulations of law in force and Regulations of enrollment.
Article 24. Procedures for registration and notices of enrollment targets
Each school shall register its annual enrollment targets with the Service of Labor, War Invalids and Social Affairs and its governing body (as specified in Appendix 02). Each Service of Labor, War Invalids and Social Affairs shall send a consolidate report to General Department of Vocational Education of the Ministry of Labor, War Invalids and Social Affairs before every January 15.
IMPLEMENTATION
Article 25. Rights and responsibilities of the Ministry of Labor, War Invalids and Social Affairs
1. Inspect and oversee enrollment activities, determination and achievement of enrollment targets by schools as prescribed by law.
2. Take charge and cooperate with Ministries and agencies; the People’s Committees of provinces and central-affiliated cities shall inspect the secondary check results of their affiliated schools if they receive any claim from candidates.
1. Direct, instruct, inspect and consolidate a report on implementation of this Circular within their scope of management.
2. Cooperate with the Ministry of Labor, War Invalids and Social Affairs in implementing this Circular. Difficulties or new issues that arise during the implementation of this Circular should be reported to the Ministry of Labor, War Invalids and Social Affairs for consideration.
3. Send periodical reports to the Ministry of Labor, War Invalids and Social Affairs as prescribed in this Circular.
Article 27. Responsibilities of schools
1. Ensure the truthfulness and accuracy of data about lecturers, teachers; facilities in determining annual enrollment targets.
2. Provide sufficient information upon request of General Department of Vocational Education affiliated to the Ministry of Labor, War Invalids and Social Affairs for verifying the registered enrollment targets.
3. Send a report on enrollment results of the previous year and register the enrollment targets in the next year on schedule as prescribed.
4. Inspect and oversee stages in enrollment activities in accordance with Regulations of the school.
1. This Circular comes into force from April 15, 2017.
2. Any regulation in this Circular not in accordance with this Circular relating to Regulations of enrollment and determining enrollment targets at intermediate or college level shall be annulled.
Ministries, ministerial-level agencies, Governmental agencies, People’s Committees of provinces and central-affiliated cities, socio-political organizations, General Department of Vocational Education, Services of Labor, War Invalids and Social Affairs, vocational training schools, junior colleges, universities that have registered training at college level and relevant entities shall implement this Circular.

APPENDIX 01
ENROLLMENT INCENTIVES
(Issued together with Circular No. 05/2017/TT-BLDTBXH dated March 2, 2017 of the Minister of Labor, War Invalids and Social Affairs)
1. Enrollment incentives by entities
a) Group 1 including:
- Entity 01: Vietnamese citizens who are ethnics and have permanent residence at: communes in area I, II, III of ethnic and mountainous areas prescribed by present Minister, Chairman/Chairwoman of the Committee for Ethnic Affairs; severely disadvantaged communes in coastal capes and islands; severely disadvantaged communes, border communes, revolutionary communes to be invested under Program 135 of the Prime Minister.
- Entity 02: Employees who have worked continuously for at least 5 years, in which they are awarded the certificates of merit for advancing worker of at least provincial level in at least 2 years.
- Entity 03:
+ Wounded soldiers, sick soldiers, and holders of “certification of people eligible for incentives for wounded soldiers”;
+ Soldiers, people’s polices on service at least 12 months at Zone 1 that are sent to study;
+ Soldiers, people’s polices on service at least 18 months that are sent to study;
+ Soldiers, people’s polices that are demobilized or certified as fulfillment of duties on service as prescribed;
+ Incentive entities prescribed in Points i, k, l, m Clause 1 Article 2 of Ordinance No. 26/2005/PL-UBTVQH11 dated June 29, 2005 on amendments to Ordinance No. 04/2012/UBTVQH13 dated July 16, 2012 of the Standing Committee of National Assembly on incentives for people with meritorious services to the revolution.
- Entity 04:
+ Children of revolutionary martyrs;
+ Children of wounded soldiers whose work capacity decrease by at least 81%;
+ Children of sick soldiers whose work capacity decrease by at least 81%;
+ Children of partisans infected with toxic chemicals whose work capacity decrease by at least 81%;
+ Children of holders of “certification of people who are eligible for incentives for wounded soldiers and their work capacity decrease by at least 81%”;
+ Children of the Hero of the People’s Armed Forces, Children of Labor Hero;
+ Persons suffering from deformities caused by toxic chemicals who are enjoying monthly benefits that are offspring of partisans;
+ Children of people with meritorious services to the revolution prescribed in Point a, b, d Clause 1 Article 2 of Ordinance No. 26/2005/PL-UBTVQH11 dated June 29, 2005 on amendments to Ordinance No. 04/2012/UBTVQH13 dated July 16, 2012 of the Standing Committee of National Assembly on incentives for people with meritorious services to the revolution.
b) Group 2 including:
- Entity 05:
+ Volunteer youth that are sent to study;
+ Soldiers, people’s polices on service at least 18 months in areas other than Zone 1 that are sent to study;
+ Commanders, deputy commanders of military command of communes, wards, district-level towns; village captains, platoon leaders of core militia or militia that have fulfilled its duty to join the core militia at least 12 months and take an exam in the military base.
Time limit for incentives enjoyed by soldiers, polices demobilized at a major which they apply for take examination or assessment at college or intermediate level is 18 months from the date on which the decision on demobilization is signed.
- Entity 06:
+ Vietnamese citizens who are ethnics and have permanent residence at areas other than those prescribed for Entity 01;
+ Children of wounded soldiers, sick soldiers, people who are eligible for incentives for wounded soldiers and their work capacity decrease less than 81%;
+ Children of partisans infected with toxic chemicals whose work capacity decrease less than 81%;
+ Children of partisans imprisoned or exiled by the enemy;
+ Children of activists in resistance to national liberation, national defense and international obligations with certificates of incentives prescribed in the Government's Decree No. 31/2013/ND-CP dated April 9, 2013 on guidelines for Ordinance on incentives for people with meritorious services to the revolution;
+ Children of meritorious people to the revolution.
- Entity 07:
+ Severely disabled people holding certificates of disability issued by competent authorities as prescribed in Joint Circular No. 37/2012/TTLT-BLDTBXH-BYT-BTC-BGDDT dated December 28, 2012 of the Ministry of Labor, War Invalids and Social Affairs, the Ministry of Health, and the Board of Directors on determination of impairment levels conducted by Impairment Assessing Council;
+ Excellent employees in all of economic sectors that are awarded titles of skilled craftsman and artisans of at least provincial level or ministerial level or creativity worker’s badges of Vietnam General Confederation of Labor or Central Committee of Ho Chi Minh Communist Youth Union;
+ Nurses, prescription clerks, medical orderlies, pharmacy technicians, physician assistants/physician associates, intermediate pharmacists that have worked for at least 3 years and apply for taking examination in medicine or pharmacy major.
c) Other entities prescribed in applicable law shall be subject to consideration of the Ministry of Labor, War Invalids and Social Affairs;
d) A person eligible for multiple incentives shall be solely eligible for the highest incentive.
2. Direct admission
a) If a Labor Hero, Hero of the People’s armed forces, Labor Hero in the resistance period, or national advanced worker has graduated from at least an upper secondary school, he/she shall be eligible for direct admission to a college; if he/she has graduated from a lower secondary school or an upper secondary school (or equivalent), he/she shall be eligible for direct admission to a vocational training school;
b) If a person who had been to be admitted to a number of schools but received a mobilization command to take military service or concentrated volunteer youth, and then has fulfilled duties and has been demobilized, still has not been admitted to any long-term full-time school, at least a regiment or general volunteer youth team shall recommend one of those schools to consider admitting him if he has satisfied health conditions and obtain sufficient valid documents. If his study has been interrupted for at least 3 years and he wishes to take a preparatory course before entering into the school official, he/she may be recommended to such preparatory courses;
c) A candidate who has won at least a consolation prize in the Olympic competition, the science and technology contest, the examination of excellent students at least provincial level shall be admitted directly to the intermediate level and has won at least a consolation prize in the examination of national excellent students, or the national science and technology competition, has graduated from a secondary school and is directly admitted to a college in or relating to his major for which he has won the prize If the candidate has not been graduated from an upper secondary school or a lower secondary school, he/she has right to reserve his/her academic results after graduation;
d) A candidate who has graduated from a secondary school and is a member of national team certified the completion of the task of participating in the official international tournament by the Ministry of Culture, Sports and Tourism, including: World Championships, World Cup, Olympic Games, Asian Games (ASIAD), Asian Championships, Asian Cup, Southeast Asian Games, Southeast Asian Games ( SEA Games), the Southeast Asian Cup will be admitted directly to a college and a candidate who has awarded at least a consolation prize at provincial level in physical training and sport tournaments will be admitted directly to a vocational training school in physical education, sports or physical training according to the regulations of each school;
dd) An artistic talent candidate who has graduated from an upper secondary school or from an art school at intermediate level, or has won an official prize in an international art contest shall be admitted directly to a college in equivalent major, and a candidate has won at least a consolation prize in an art contest at least provincial level shall be admitted directly to an art or talent school in equivalent major at intermediate level as prescribed in regulations of each school;
Each candidate who has won a prize in physical training or sports or artistic talent shall be eligible for incentives within a period not exceeding 4 years until the date on which such candidate applies for examination or assessment to the school.
e) In case of a candidate being a severely disabled person holding a certificate of disability issued by a competent authority as prescribed: Principals of schools shall, according to his/her academic transcripts at upper secondary school, his/her health conditions, and requirements of given majors, consider admitting him/her to the schools;
g) In case of a candidate being a foreigner who wish to study vocational training schools or junior colleges in Vietnam: Principals of schools shall, according to his/her academic transcripts at upper secondary school, his/her knowledge and Vietnamese proficiency in accordance with regulations of the schools, consider admitting him/her to the schools;
h) A candidate who has permanent residence for at least 3 years, has studied for 3 years and graduated from an upper secondary school in a poor district (student of ethnic boarding school according to his/her permanent residence) from the date on which he/she submits an application for assessment as prescribed in Resolution No. 30a/2008/NQ-CP dated December 27, 2008 of the Government on programs for facilitating rapid and sustainable poverty reduction and Decision No. 293/QD-TTg dated February 5, 2013 of the Prime Minister on dedicated budget from central government budget to 23 poor districts with high rate of poor households eligible for investment in infrastructure as prescribed in Resolution No. 30a/2008/NQ-CP on programs for facilitating rapid and sustainable poverty reduction for 61 poor districts; a candidate being an ethnic as prescribed in applicable regulations of the Prime Minister and a candidate of 20 poor districts in borders or islands of the Mekong delta;
i) A person who obtains a Diploma Level 4 of VQF of at least distinction level and a holder who obtains a Diploma Level 4 of VQF and has worked for at least 2 years in his/her major in accordance with Clause 2, Article 3 of this Circular shall be directly admitted to the same major at college level;
k) A person who obtains a Diploma Level 4 of VQF and has won at least a first, second, or third prize at a national workmanship contest and complies with Clause 2 Article 3 of this Circular shall be directly admitted to the same major at college level;
l) A candidate who has graduated from a lower secondary school or an upper secondary school (or equivalent) with conduct is ranked at least good level and is one of the following entities shall be directly admitted to a vocational training school:
+ Children of revolutionary martyrs;
+ Children of wounded soldiers, sick soldiers, people who are eligible for incentives for wounded soldiers and their work capacity decrease by under 81%;
+ Orphans.
2.3. Candidates waiving their rights to direct admission may enjoy incentives for assessment to study at college level
a) Candidates having won prizes in national excellent students contests, national workmanship contests, national science and technology contests and having graduated from upper secondary schools shall be considered being admitted by schools' Principals;
b) Candidates having won silver or bronze medals of annual National First Division Championship and candidates having received certificates of National first-level athlete and have graduated from upper secondary schools shall enjoy incentives for assessment to study physical training and sport college level or equivalent majors of schools;
c) Artistic talent candidates who have graduated from upper secondary schools or art and talent school at intermediate level, who have won official prizes in national professional art contests in terms of singing and dancing shall enjoy incentives for assessment to study at college level as prescribed in regulations of each school;
Each candidate who has won a prize in physical training or sports or artistic talent shall be eligible for incentives within a period not exceeding 4 years until the date on which such candidate applies for examination to the school.
d) Annually, candidates who are eligible for direct admission shall prepare an application for direct admission (application form, evidence for direct admission eligibility) and send it directly to their intended schools during the period in which the schools receive applications.
4. If a candidate who is eligible for direct admission but has waived the right to direct admission applies for intermediate level in the form of examination or assessment, he/she shall be given extra score as prescribed in regulations of the school which is included his/her total score of subjects.
Annually, candidates who are eligible for direct admission shall prepare an application for direct admission (application form, evidence for direct admission eligibility) and send it directly to their intended schools during the period in which the schools receive applications.
5. Enrollment incentives by areas
a) A candidate who has studied continuously and graduated from upper lower secondary school in a particular area shall enjoy incentives applicable to such area. If he/she has transferred to another school within 3 years at upper secondary level (or vocational training level), the area in which he/she has studied longer shall be preferred as the incentive area. If he/she has studied at three different schools in areas with different incentives or has studied in a school a half of course time and in another school the other half, he/she shall enjoy the incentives applicable to the area from which he/she graduates. These regulations apply to all candidates, including candidates who have graduated before the enrollment year;
b) The following entities shall enjoy incentives according to permanent residence:
- Students of upper-secondary ethnic boarding schools;
- Students of preparatory schools, classes;
- Students of professional source classes opened as decided by Ministries, ministerial-level agencies or the People’s Committees of provinces;
- Students has stayed in permanent residence (during the study time of upper secondary schools or vocation training school) for more than 18 months at communes of area III and communes having severely disadvantaged villages in ethnic and mountainous areas as prescribed by Minister, Chairman/Chairwoman of the Committee for Ethnic Affairs, severely disadvantaged communes at coastal capes and islands; severely disadvantaged communes, border communes, revolutionary communes to be invested under Program 135 as decided by the Prime Minister or they have studied at upper secondary schools (or vocational training schools) in districts or district-level towns having at least one of the aforesaid communes;
- In case of a soldier or a people’s police being sent to take examination, if he/she has stationed in an area for at least 18 months, he/she shall enjoy the incentives applicable to such area or according to his/her permanent residence before joining the army, depending on which area has higher incentives, if he/she has stationed in an area under 18 months, he/she shell enjoy the incentives applicable to his/her permanent residence before joining the army.
c) Enrollment areas shall be divided as follows:
- Area 1 includes: communes in area I, II, III of ethnic and mountainous areas according to current regulations corresponding to the candidates’ study time at upper secondary schools, lower secondary schools, or vocation training schools; severely disadvantaged communes in coastal capes and islands; severely disadvantaged communes, border communes, revolutionary communes to be invested under Program 135 in accordance with applicable regulations.
- Area 2 – rural area includes: Administrative divisions that are not in Area 1, Area 2, and Area 3.
- Area 2 includes: District-level towns, provincial cities; district-level towns, suburban districts of central-affiliated cities (other than communes in Area 1).
- Area 3 includes: Urban districts of central-affiliated cities. Candidates in Area 3 shall not be eligible for incentives by areas.
6. Priority score frame by entities and areas
The difference of cut-off marks between two succeeding groups of entities is 1.0 (one), between two succeeding areas is 0.5 (a half) according to the scale of 10.
