PROMULGATING ECONOMIC AND TECHNICAL NORMS FOR OPERATION, EXPLOITATION AND MAINTENANCE OF VESSEL TRAFFIC SERVICE SYSTEM

Pursuant to the Government's Decree No. 107/2012/ND-CP dated December 20, 2012 defining the functions, tasks, entitlements and organizational structure of the Ministry of Transport;

At the request of general director of Vietnam Maritime Administration and general director of Department of Science and Technology,

The Minister of Transport promulgates the economic and technical norms for operation, exploitation and maintenance of the Vessel Traffic Service system.

Article 1. Enclosed herewith is the economic and technical norms for operation and maintenance of the Vessel Traffic Service system (abbreviated to “VTS system”).

Article 2. This Circular takes effect since October 15, 2016 from October 15, 2016 and supersedes the Minister of Transport’s Circular No. 13/2013/TT-BGTVT dated July 04, 2013 promulgating economic and technical norms for maintenance of VTS monitoring the Saigon – Vung Tau navigation channel.

Article 3. Chief of the Ministry Office, Chief Inspector of the Ministry, general directors of Vietnam Maritime Administration, heads of relevant agencies, organizations and individuals shall be responsible for executing this Circular./.

Chapter I

EXPLANATION AND APPLICATION

1. Scope and regulated entities

1.1. Governing scope

These norms apply to VTS systems managed by the units affiliated to Vietnam Maritime Administration.

1.2. Regulated entities

These norms apply to agencies, organizations and individuals in connection with operation and maintenance of VTS systems managed by the units affiliated to Vietnam Maritime Administration.

2. Contents of norms

- Labor consumption norm means the consumption of workforce required to complete an amount of work or a technological step during the operation, exploitation and maintenance of equipment subsystems of a VTS system. Labor consumption norm is determined by the number of workdays required by the workforce to complete an amount of operation and maintenance work. Rank of labor prescribed in the norms is the average rank of the workforce which performs the work.

- Electrical energy consumption rate means the consumption of electrical energy determined based on design capacity, quantity and operating time of each type of equipment of the VTS system according to statistical figures about operating conditions of such equipment.

- Fuel consumption rate means the consumption of fuel and lubricating oil determined based on design capacity, quantity and operating time of each type of equipment of the VTS system.

- Material consumption rate for operation, exploitation and maintenance means the consumption of materials and instruments for operation, exploitation and maintenance of the VTS system.

- Production instrument consumption rate means the consumption of instruments and equipment for operation and exploitation of the VTS system.

- Spare part rate means the consumption of spare parts for replacement to ensure stable, constant and round-the-clock operation of the VTS system.

3. Interpretation of terms

In these norms, some terms are construed as follows:

- “VTS system” means the marine traffic monitoring system.

- “Operation” means actions put on equipment and facilities of the VTS system in operation to ensure it operates in accordance with required functions.

- “Exploitation” means the performance of professional activities based on effective use of the system’s functions in order to achieve set objectives.

- “Maintenance” means actions performed on equipment and facilities of the VTS system during downtime or operations at lowest capacity on a periodical basis in order to ensure the system is ready to operate in accordance with required functions.

- Economic and technical norms are foundations for the formulation of labor use plans and fiscal plans by the units tasked with carrying out management, operation, exploitation and maintenance of the VTS system.

- Economic and technical norms are foundations for effective arrangement of labor to increase labor productivity and streamline the management apparatus, and implementation of piecework mechanism for management, operation, exploitation and maintenance of the VTS system.

- Other tasks not prescribed herein shall be subject to estimated norms according to laws

- In addition to these general regulations, each subject matter of the norms also includes explanations and particular regulations.

5. Legal foundations for formulation of the norms

- The Labor Code 2012 and guiding documents;

- Vietnam Maritime Code 2005 and guiding documents;

- The Minister of Labor, Invalids and Social Affairs’ Circular No. 26/2015/TT-BLDTBXH dated July 14, 2015 providing instructions on determination of cost of salary in the cost price of a product or service for public use using state budget.

1. Labor consumption norm

Based on the work components mentioned in Part A “Work components”, labor consumption shall be determined according to Level 1 Table and Level 2 Table. Titles and pay grades of the operating workforce shall be stipulated in accordance with the Section I.8 (a) of the Annex enclosed with the Minister of Labor, Invalids and Social Affairs’ Circular No. 26/2015/TT-BLDTBXH.

Chapter III

ECONOMIC AND TECHNICAL NORMS FOR EXPLOITATION OF VTS SYSTEM

A. WORK COMPONENTS

1. Information collection and processing

Collection of information means the collection of information reported from ships, relevant organizations and individuals and information detected by the system during vessel traffic monitoring and regulating. Information collected includes:

- Information reported from a ship before it enters VTS area: Ship name, call sign, draught, destination port, information about maritime safety, security and environment pollution (if any).

- Information reported from a ship when it arrives at the reporting line of position: Ship name, call sign, information about maritime safety, security and environment pollution (if any).

- Information reported from a ship when it completes movement process: Ship name, call sign, location, information about maritime safety, security and environment pollution (if any).

- Information reported from a ship before it leaves location base: Ship name, call sign, draught, estimated time of departure, destination, information about maritime safety, security and environment pollution (if any).

+ Information about ships: Ship name, call sign, ship’s technical specifications, cargo, departure and destination ports, speed, direction, location, itinerary;

2. Management, monitoring and regulation of vessel traffic and provision of information for ship navigation

Based on the information collected, VTS operators shall monitor and regulate vessel traffic and provide information for ships to navigate safely.

- For ships which are expected to enter VTS area: Issue the notice of available routes or cancellation of movement according to the port authority's movement plan; provide information about maritime navigation, conditions of navigation channels, construction works across the river, wharves, floating docks, anchorage; provide information about meteorology and hydrology; recommend relevant regulations.

- For ships which operate within VTS area: Provide information to support navigation.

- For ships which are expected to leave location base: Issue the notice of available routes or cancellation of movement according to the port authority’s movement plan; provide information about maritime navigation, conditions of navigation channels, wharves, weather and other information.

- For ships which complete movement process: Provide information about maritime navigation, conditions of navigation channels, wharves and weather.

3. Provision of information to support state administration

- Provide information to support investigation of maritime accidents, incidents, search and rescue operations.

4. Provision of information to support activities of agencies, units

- Provide information at the request of relevant agencies, units.

B. CONSUMPTION NORMS

Based on the work components mentioned in Part A “Work components”, labor consumption shall be determined according to Level 6 Table. Titles and pay grades of the workforce shall be stipulated in accordance with the Section I.8 (a) of the Annex enclosed with the Minister of Labor, Invalids and Social Affairs’ Circular No. 14/7/2015.

ECONOMIC AND TECHNICAL NORMS FOR MAINTENANCE OF VTS SYSTEM

PART 1. VTS CENTER

1. CONTROL AND DISPLAY EQUIPMENT

- Study materials, equipment diagrams and processes;

- Prepare standby equipment for replacement if necessary to ensure continuity of the system.

b) Examination of pre-maintenance equipment

- Examine current conditions of the workstation including features and functions of the equipment. This task shall be recorded to serve remedial work for problems likely to occur after the maintenance.

- Run the system software on the workstation, record performance outcomes to make a comparison after the maintenance.

- Copy data of the entire system into a DVD drive;

- Copy Image Backup of the server into a DVD drive;

- Examine and copy all configuration settings of the system into a separate file.
