CIRCULAR

ON AMENDMENTS TO ECONOMIC - TECHNICAL NORMS FOR THE MANAGEMENT AND MAINTENANCE OF INLAND WATERWAYS AS DEFINED IN THE CIRCULAR No 64/2014/TT-BGTVT DATED 10 NOVEMBER 2014 BY MINISTER OF TRANSPORT

Pursuant to the Law of Inland waterway transport dated June 15, 2004 and the Law on amendments to certain articles of the Law of inland waterway transport dated June 17, 2014;

Pursuant to the Government’s Decree No. 46/2015/ND-CP dated May 12, 2015 on the quality management and maintenance of buildings;

Pursuant to the Government’s Decree No. 107/2012/ND-CP dated December 20, 2012 on the functions, missions, authority and organizational structure of the Ministry of Transport;

At the request of the Head of Department of Transport infrastructure and the Head of Vietnam Inland Waterway Administration;

Minister of Transport promulgates the Circular on amendments to economic - technical norms for the management and maintenance of inland waterways as defined in the Circular No. 64/2014/TT-BGTVT dated November 10, 2014 by Minister of Transport.

Article 1. Amendments to economic - technical norms for the management and maintenance of inland waterways as defined in the Circular No. 64/2014/TT-BGTVT dated November 10, 2014 by Minister of Transport

1. The following amendments apply to Point 1.3, 1.5, 1.9, 1.11, 2.27 and 2.28, Part I, Chapter II:

 “1.3. Ad hoc post-disaster inspection: Inland waterway management authorities (Vietnam Inland Waterway Administration, Department of Transport or inferior units designated thereof) shall lead and, along with inland waterway maintenance organizations, cooperate with concerned bodies in inspecting and assessing severe damage caused by an abrupt natural disaster.”

 “1.5. Preliminary surveying of shoals and channels in complicated areas: Local inland waterway management agency (Vietnam Inland Waterway Administration Branch or designated inferior unit of Vietnam Inland Waterway Administration or Department of Transport) or inland waterway maintenance organization, when examining a line, shall carry out a preliminary survey into shoals or intricate channel legs and adumbrate a drawing of the shoals or channel legs under inspection to adjust signs and administrate the line’s channels in timely manner.”

 “1.9. Standing guard for natural disaster prevention, search and rescue: The inland waterway management agency shall cooperate with the inland waterway maintenance organization, when a natural disaster likely impacts on an area under their management, to deploy equipment and assign personnel on duty as per regulations on natural disaster prevention, search and rescue."

 “1.11. Liaison with local authorities: Inland waterway management agencies shall coordinate with the People's Committees of the communes and wards along inland waterway lines, functional units (police, border guard, transport inspectorate) and owners of inland waterway facilities, by echelon, to safeguard signs, propagate the legislation on inland waterway transport, protect inland waterway infrastructure and perform other tasks in connection with the inland waterway lines under their management.”

 “2.27. Maintenance of plastic and composite buoys: Clean signaling buoys to maintain the brightness of their colors. The norm for steel buoy painting shall apply if color coating is required."

 “2.28. Maintenance of regulatory facilities, locks, dams, signposts’ riprap base:

- Locks and dams shall be maintained according to specific maintenance procedures approved for each facility as per current regulations.

- The surface of regulatory dikes and signposts’ loose riprap base shall be re-faced and refitted, respectively. Bushes on dikes shall be cleared or re-grown on vegetative dikes."

2. The following amendments apply to Point 1.1, 1.4, 1.5, 1.7, 2.1.1, 2.1.2, 2.1.3, 2.1.4, 2.1.5a, 2.1.6, 2.1.9, 2.1.10, 2.1.12, 2.1.13, 2.1.15, 2.1.17, 2.2.1, 2.2.3, 2.2.4, 2.2.5, 3.6, 3.12, 3.13 and 3.14, Part II, Chapter II:

Notes:

- The figure in parentheses apply to inland waterway lines in the South;

- The frequency of the installation and withdrawal of buoys in the areas susceptible to hydroelectric reservoir’s flood discharge shall increase by 01 time per year when the water level rises by 1.5 m or more;

- The frequency of the adjustment of buoys on Tien river, Hau river and other rivers susceptible to hydroelectric reservoir’s flood discharge shall increase by 01 time per year when the water level rises by 1.5 m or more;

- The frequency of the mid-term color painting of steel signpost (buoy, post, sign, beacon, battery box, anti-climbing barrier) in the saltwater environment shall increase by 01 time per year.

- The frequency of the relocation of signposts (with non-concrete base) in high mountainous areas shall increase by 5% of total amount of signposts per year;

- Standing guard for information technology issues shall exist only if information technology is in use."

3. Point 2a is added to Section 2, Part I, Chapter III:

 “2a. Preliminary shoal surveying by echo sounder and differential global positioning system (DGPS)

Task:

- Prepare the equipment and machines;

- Steer the vessel from the central point of the channel to the first measurement point;

- Carry out the measurement as per technical requirements;

- Finish the work and steer the vessel to the central point of the channel;

- Make and send the report and basic drawing to the relevant inland waterway management agency.

4. The following amendment applies to Section 5, Part II, Chapter III:

“5. Maintenance of steel buoys

Task:

- Prepare a scraping tool and rust (removing) grinder; painting tools and materials, bending and forming tools;

- Fasten the buoy with a pad, scrub the buoy, remove washers; scrape and remove rust inside and outside the buoy. Clean the buoy and sign before painting;

- Bend and reform the dented part of the buoy (if any);

- Apply a layer of anti-rust paint on the interior and exterior of the buoy and sign;

- Apply two layers of color paint on the exterior of the buoy and sign according to the rules of signaling, affix the signal code;

- Tighten washers to assure water tightness;

- Move the buoy into the defined position;

- Gather the tools and clean the working area.

Carry out the maintenance tasks in a workshop without the withdrawal, placement and transportation of the buoy.
