Pursuant to Law on Organization of the Government dated December 25th 2001;
Pursuant to Fisheries Law dated November 26th 2003
Determining request of the Minister of Fisheries (at submission paper No. 1954/TTr-BTS dated August 25th 2005 and Official letter No.2314 dated October 04th 2005) and comments contributed by Ministry of Planning and Investment (at Official letter No.6344 BKH/KTNN dated September 16th 2005), Ministry of Finance (at Official letter No.11361/BTC-DT dated September 09th 2005), Ministry of Transport (at Official letter No.5664/BGTVT-KHDT dated September 14th 2005), National Committee for Search and Rescue (at Official letter NO. 67/UB dated September 12th 2005), National Steering Committee for prevention and control of floods and storms (at Official letter No.229/CLBTW dated September 9th 2005);
HAS DECIDED:
Article 1. Approve the adjustment of Masterplan on anchoring places of fishing vessels for storm-resistance purpose by 2010 and vision by 2020, with the following content:
1. Objective and viewpoint of the masterplan
The anchoring places of fishing vessels for storm-resistance purpose have been systematically established as taking advantages of locations which are in favorable natural conditions, near the fishing grounds and seas with high storm frequency, fit with fisher's common practices, ensure the safety for human and fishing vessels and may limit the damages caused by storms. Those locations are also capable of supplying logistic service for fishing vessels in order to enhance the use effectiveness.
2. Scope of application of the masterplan
The masterplan shall apply to anchoring places of fishing vessels for storm-resistance purpose in the coastal provinces and cities as well as in some islands.
The time for adjustment of masterplan shall be by 2010 and the vision shall be by 2020.
3. Classification, orientation and criteria for establishment of anchoring places of fishing vessels for storm-resistance purpose
The criteria which is set up based on the natural characteristics, common practices of fishers and the system of anchoring places, shall be as follows:
a. Anchoring place for storm -resistance at regional level shall be met with following conditions:
- It shall be near the focal fishing grounds where attract number of fishing vessels from several provinces and requirement on the time for moving of the fishing vessel to the safe place is met.
- It shall have the high storm frequency.
- It shall have favorable natural conditions, securing the safety of fishing vessels.
- It shall receive around 800 - 1,000 fishing vessels of all types (including vessels of 1,000 CV and foreign fishing vessels).
b. Anchoring place for storm -resistance at province and city level shall be met with following conditions:
- It shall be near the traditional fishing grounds of the localities and requirement on the time for moving of the fishing vessel to the safe place is met.
- It shall have favorable natural conditions, securing the safety of fishing vessels.
- It shall receive the local fishing vessels of all types.
4. Planning of anchoring system by 2010 and vision by 2020 (with the list attached)
a. The planning set out depending on the following criteria:
- During the period of 2006-2010: there will be as many as 75 anchoring places for storm-resistance including 13 anchoring places at regional level and 62 anchoring places at province level.
- Orientation by 2020: there will be as many as 98 anchoring places for storm-resistance including 13 anchoring places at regional level and 85 anchoring places at province level.
b. The planning set out depending on the coastal areas:
- In the Tonkin Gulf: there will be 28 anchoring places, including 25 coastal anchoring places and 03 island anchoring places (Co To - Thanh Lan, Cat Ba and Bach Long Vy).
- In central region: there will be 39 anchoring places, including 34 coastal anchoring places and 05 island anchoring places (Con Co, Cu Lao Cham, Ly Son, Da Tay and Phu Quy).
- In the southeast region: there will be 19 anchoring places, including 17 coastal anchoring places and 02 island anchoring places (Con Dao and Hon Khoai).
- In southwest region: there will be 12 anchoring places, including 7 coastal anchoring places and 05 island anchoring places (Nam Du, Hon Tre and 3 areas in Phu Quoc, An Thoi, Mui Ganh Dau and Vung Trau Nam).
5. Investment regime
a. Central budget shall be used to support the investment in the major infrastructure such as dredge of entering channels, building of wave and sand protection dykes, anchoring pillars, float pillars and signal lighting system.
Central budget shall be arranged in 5 year, annual plans and according to target programmes on the basis of investment projects approved by competent authorities as regulated by legislation.
b. Local budget shall be arranged annually to upgrade the infrastructure of the anchoring places and shall cover the management cost after investment.
c. All economic sectors' capital shall be mobilized to invest in the construction of infrastructure for production, trade, fisheries logistic services as planned.
d. Management of the implementation and construction:
- Ministry of Fisheries shall directly control the investment in the construction of anchoring places at regional level.
- People's Committee of provinces and cities under central control shall directly control the investment in construction of anchoring places at provincial and city's level.
6. Prioritized projects
During the period of 2006-2010, the investment in the construction of anchoring places at regional level and necessary ongoing projects shall be prioritized.
1. The Ministry of Fisheries shall be in charge of:
a. Direction, making guidance on the implementation of the materplan throughout the country; formulation and promulgation of selection criteria, regulations for management and use of anchoring places.
b. Coordination with coastal localities to identify the specific location of the anchoring places to ensure the right purpose and criteria, avoiding the dispersion and rank the order of priority for investment.
c. Appraisal and approval of projects on the construction of anchoring places at regional level, to ensure the right purpose and follow the current regulations and be in charge of its decisions.
d. Coordination with relevant Ministries and sectors as well as coastal localities to hold meetings to draw experiences on the investment in anchoring places in the specific period, ensuring the best implementation of the masterplan.
2. People's Committees of provinces and cities shall be responsible for:
a. Appraisal and approval of project on the construction of anchoring places at provincial level upon agreement of the Ministry of Fisheries, ensuring the right purpose and compliance with current legislation and be in charge of its decisions.
b. Management and use of anchoring places after investment, ensuring the long-term and effective use.
c. Arrangement of land use as planned, allocation of budget according to 5-year and annual plans on the basis of implementation progress of the investment and of the costs for upgrade and management of the construction.
d. Direction of functionary agencies to best perform the dissemination and information of location, scale, service capacity of the anchoring places as well as direction of the anchoring; mobilization of financial sources from all economic sectors for establishment of logistic services in convenient places and enhancement of use effectiveness.
e. Ministry of Planning and Investment and Ministry of Finance shall be in charge of harmonization of budget allocation according to 5-year and annual plans on the basis of implementation progress of the investment and of the costs for upgrade and management of the construction.
Article 3. This Decision shall come into force 15 days after being posted on the Official Gazette and shall replace the Decision No.135/2001/QD-TTg dated September 14th 2001.
Article 4. Ministers of Fisheries, Planning and Investment, Finance; chairmen of People's Committees of coastal provinces and cities; head of National Steering Committee for prevention and control of floods and storms; chairman of National Committee for Search and Rescue shall be responsible for implementation of this Decision.
