DECREE
AMENDING AND SUPPLEMENTING A NUMBER OF ARTICLES OF DECREE NO. 06/CP OF JANUARY 20, 1995 DETAILING A NUMBER OF ARTICLES OF THE LABOR CODE ON LABOR SAFETY AND SANITATION
THE GOVERNMENT
Pursuant to the Law on Organization of the Government of September 30, 1992;
Pursuant to the Labor Code of June 23, 1994;
At the proposals of the Minister of Labor, War Invalids and Social Affairs and the Minister of Health,
DECREES:
Article 1.- To amend and supplement Decree No. 06/CP of January 20, 1995 detailing a number of articles of the Labor Code on labor safety and sanitation as follows:
1. To amend Clause 2 of Article 3 as follows:
"2. Organizations and individuals, when using the machines, equipment, materials and/or substances, which strictly require labor safety and sanitation as specified in the List issued by the Ministry of Labor, War Invalids and Social Affairs and the Ministry of Health, shall have to declare, register and apply for permits to use them according to the current provisions of labor legislation".
2. To amend and supplement Clause 1 of Article 12 as follows:
"1. When a labor accident occurs, the employer must organize the investigation and make a record thereon, with the participation of the representative of the executive committee of the local trade union as provided for by the Ministry of Labor, War Invalids and Social Affairs and the Ministry of Health.
The record must fully state the happening of the labor accident, the injury and damage caused thereby, its cause, the determination of responsibility and must be signed by the employer and the representative of executive committee of the local trade union".
3. To amend Clause 6 of Article 19 as follows:
"6. The inspection of the labor safety and sanitation in the fields of radioactivity, oil and natural gas prospection and exploitation, and railway, water way, land and air transport means, and the armed forces units shall be carried out by their agencies in coordination with the Ministry of Labor, War Invalids and Social Affairs and the Ministry of Health".
Article 2.- This Decree takes effect 15 days after its signing.
Article 3.- The ministers, the heads of ministerial-level agencies, the heads of the agencies attached to the Government, the presidents of People’s Committee of provinces and centrally-run cities shall have to implement this Decree.
